i filed to my mother i-485 and she had received RFE its says page 5 of form i-864 affidavit of support submitted is blank or missing.

we didnt filled out the page 5 part 7 because its really clear on the instruction. if your income, or the total income for you and your household, from the 24c exceeds the federal poverty guidelines for your household size. YOU ARE NOT REQUIRED TO COMPLETE THIS PART. SKIP TO PART 8

how bout you did you filled it out this form?

i dont know if they make a mistake or we make a mistake.

We also left it blank but included the page when we submitted our AOS packet. I'm not sure - it could have been an error on their part?

The instructions clearly say "Skip to Part 8" and that's what we did too.

Yes you are correct, if you are not using assets you do not need to fill this in.

My only question would be - did you only submit evidence of employment income? You didn't add anything 'extra' to the package like bank statements - no proof of any assets at all?

The instructions clearly say "Skip to Part 8" and that's what we did too.

This was my first thought - that perhaps you hadn't submitted all the pages. You should, even if they are blank.

K-1:

January 28, 2009: NOA1

June 4, 2009: Interview - APPROVED!!!

October 11, 2009: Wedding

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.

also yesterday you said you and your husband filled for your mother,

husband as cosponser and he put 2 as depandents

if he is the cosponsor and has you as depandent he should put 3 this includes you himself and your mother ,

so since you filled with a cosponsor did the both of you filled out an application ?

yes we filled it out i filled out i-864 and my husband he filled out i-864a. the thing is went we submit the form we didnt submit blank form the page 5 part 7 we just only submit the form that we filled out.

i didnt send the blank

the RFE says page 5 of form affidavit support submitted is blank or missing.

it means i had to submit the blank or return the blank for the rfe i just confused

bank statements - proof of liquid cash avalable

the monthly papper you get from your bank saying how much you have in the account

I believe Trailmix was asking if she had sent any "asset" type evidence, without filling out the page in question. (like bank statements).

If she did, but didn't fill out the "asset" section, then they will ding her on the blank section for assets.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Yikes! After reading this thread, I got worried and checked the copy we made of our packet. My husband left the I-864 assets part (page 5) blank because with his annual income, he already meets the poverty guidelines. BUT I just realized that the house settlement statement and car title was included with the I-864 supporting documents!!! WAAAAAH! (We had included both in our I-129F petition and just took the copies of his tax returns and W-2s for the AOS packet from our old copy of our I-129F packet)... We did include his pay stubs for the most recent 6 months though (monthly military L.E.S. - Leave and Earnings Statement). Would that be proof enough of his income? Do you think we'll get an RFE for not filling out page 5 too?!

I'm guessing the OP got the RFE because they omitted page 5 even though it was blank?

Yes, we have two cars - but I believe only one car title was included (my husband hadn't bought the 2nd car yet before we filed the I-129F).

Oh I really hope they just overlook the house statement and car title! *cries*

I'll just keep my fingers crossed and pray...
