I-864 or I-864a

Ok i am going to print off all my papers today and i don't know which i form i am filling out for joint sponsor. It is for my brother in-law and we do live with him so is it I-864 or I-864A i really don't want to send in the wrong one and screw this all up.

I-864 is for you, & the I-864A is for your joint sponsor

According to the I-864A instructions BIL does not meet the relation test ( related to the sponsor as a spouse, adult child, parent, or sibling ) and would file an I-864. In that case the income of the BIL cannot be combined with petitioners income.

Unless you claimed your BIL as a dependant on your last income tax return, then you cannot use the I-864A - from the instructions - page 1:

Who May Be Considered a "Household Member" for Purposes of This Form?

A relative who has the same principal residence as the sponsor and is related to the sponsor as a spouse, adult child, parent, or sibling;

A relative or other person whom the sponsor has lawfully claimed as a dependent on the sponsor's most recent Federal income tax return even if that person does not live at the

same residence as the sponsor;

In my opinion it is important, really, to read all of the instructions for these documents, the information in them is very important and it will save you making mistakes on the forms you submit and having to redo them or correct them.

Yeah there just really confusing instructions it's almost like they do that so you need help. I find myself re-reading what the instructions say a lot.. Thank you though.
