Hi all,

So, this might just be a "wait and see" situation, but I'm hitting myself for it a bit, so I'm hoping someone has some insight.

My fiance is a citizen of the UK, but is a permanent resident of New Zealand (and has lived there for 20 yrs). However, it didn't occur to me until a few weeks after we sent our initial I-129F that I should've included a copy of his passport page that states he is a legal PR of New Zealand. So, my worries/questions are this:

1) I know that he can have his interview in New Zealand, as a LPR, but will they know to send our petition there instead of the UK?

2) Are we likely to get an RFE for proof of his residence in New Zealand? (D'oh!!!)

3) If our petition does end up in London, a) will we be able to find out from NVC that they sent it there? and b ) will we be able to request that they send it to Auckland, New Zealand?

14 April 2010: Interview (159 days) Approved!!

30 April 2010: Married!

AoS

18 May 2010: NOA1 for AoS, EAD and AP

8 June 2010: Case transferred to CSC

10 June 2010: Biometrics completed

31 July 2010: EAD and AP received!

9 Sept. 2010: RFE email for AoS

(RFE for medical. We replied with letter stating that it's not required since done overseas within one year)

18 January 2010: Interview - passed! Card production ordered!

Unless NVC is just not paying attention, they'll send the case to the Consulate you told them to in line 20 of the I-129F petition.

Facts are cheap...knowing how to use them is precious...

I assume you put his address as a NZ address... so it's likely that they'll send it there. I don't think they would send it to the wrong consulate if you're living overseas for a while. Would they expect and Aussie living in France to fly back to Australia?

Ooo this is what I found on the form: "NOTE: (Designation of a U.S. embassy or consulate outside the country of your fiancé(e)'s last residence does not guarantee

acceptance for processing by that foreign post. Acceptance is at the discretion of the designated embassy or consulate.)"
