Hey all,

I am here for ROC but friend of mine asked me a question and I have no clue... She is engaged to someone from Germany she was planning to move to Germany 'till 3 weeks ago. Her fiancee got laid off and they have decided to try U.S. Which would be better for them; if he comes here and they get married here (I believe they have to wait at least 3 months if he enters with tourist visa) or it is better them to get married in Germany and apply for CR-1?

It is not a good idea to come on a NON immigrant tourist visa (or VWP) with the intention of immigrating and thus circumventing US immigration law

K-1 sounds like the best route for your friend.

Tell your friend coming to the US on a tourist visa, or VWP with the intentions of actually coming to immigrate is illegal (regardless of how much time is between arrival and marriage).

K-1 sounds like the best route for your friend.

I will let her know but I would have tought marriage would be taken into consideration more faster than engagement(sorry for being naive). how long does it take to complete K-1 from the application date?

The spousal visa takes longer because it has more steps and more departments to go through than a fiance visa

It takes around 8 - 12 months - sometimes longer, sometimes shorter
