Met in usa and got married in usa but lived togther in germany for past 5 years. Now live back here in USA (wife is the usc) usband traveled to us with wife but on a tourist (6mos) visa. Question is how do the get husband his greencard? do they start from the beginning with a cr1?

yes, i believe you would need to adjust his status and that's it, but would still need to file the cr-1.

Timeline:

Sent in I-130 form: 01/29/09

Interview Date: 11/08/09 (APPROVED!)

Visa in Hand: 11/12/09

POE: 01/30/10 (!!!!) at JFK Airport in NYC... can't wait!

Got the green card maybe 8 weeks after 01/30/10...

TBC....

Actually it would be an IR1 which would give you a GC for 10 years upon entry... Start with the I-130 Happy journey

10/14/2000 - Met Aboard a Cruise ship

06/14/2003 - Married Savona Italy

I-130

03/21/2009 - I-130 Mailed to Chicago lockbox

11-30-09: GOT GREEN CARD in mail!!!!!!

Citizenship Process;

1/11/2013: Mailed N400 to Dallas Texas

3/11/2013: interview.. Approved

4/4/2013. : Oath! Now a U.S. citizen!

If husband entered the US with a B2 and the intention to file for AOS to LPR, that's, strictly viewed, visa fraud.

In practice, however, we learned that even that won't matter at AOS and even if it were to come up at the interview, all that's needed is to state (truthfully, of course), that staying wasn't the original plan.

Knowing the aforementioned, I would file for AOS from the US using forms I-131, I-485, and I-765 (a freebee) concurrently.

If he entered the U.S. on the B-2 with the prior intention of staying and adjusting his status, that's committing visa fraud. In that case, it would be best to file for a CR1 and have him return to his country after his B2 expires.

If your plans changed midway, go ahead and file for AOS.
