do you think k1 fiancee visa will be approve?

hi!

I just want to ask this question not for me but for my cousin. Her fiance send their papers to VSC last October 2009. And they are just waiting for the NOA2. Does anyone knows here that my cousin's paper will be approve soon eventhough she's still 17? but she will be turning 18 next year...any advice??

I think ages for legal marriage are state-specific. They should check the laws of their home state.

If she is still 17 when she arrives and they have to get married before the visa expires

they would have to go to a state that permits marriages under 18 without parent's consent.

If she got written consent from parents in a foreign language I suppose that would have to be translated.

Also, you'd have to check with the USCIS for any age restriction, but if her age was on the

application they should take note of that and if it passes their scrutiny it should be OK.

The Embassy will also be interested in the timeline of their relationship. A 48 year old guy having sex with a 16 or 17 year old minor usually raises a few questions--as well as eyebrows.

Depending on the consulate, I'd say good luck with that. Even if it were a routinely 'easy' consulate (London), that huge of an age gap is going to be scrutinized big time.

There are some very tough consulates where the age gap is not going to raise any eyebrows. If it's very common in the local culture for the husband to be much older than the wife then it won't be a big problem. For example, they see a lot of middle aged men sponsoring very young girls in Manila, but I'm pretty sure she'd need parental permission to marry. There are also some Islamic countries where this is not uncommon - the Prophet himself had a very young wife.

Regardless, she's going to have to meet the requirements of the state in the US where she marries.

It will take a couple more months to get the NOA2. The age situation would arise at her interview. He'd better be right there for it. Otherwise, it will smell strongly like she's just interested in immigration, with marriage being the best way to get to the US.

Marriage age & restrictions by state

If the visa is approved she can go to any state where she qualifies under their rules.

That will serve as a valid marriage in whatever sate she resides in.

Can you imagine Michigan not honoring a marriage certificate from California or Florida?

Out of curiousity, wouldn't there be an issue about being 'legally free to marry' at the time of petitioning. If she was underage to marry in his state at the time of petitioning, she technically wouldn't be 'free' to marry?

That's the issue, in my eyes.

The K1 guidelines state that you must be free to marry at the petition filing. That's why people have to file their divorce decrees with the petition, not after.
