I am really confused about what I've actually accomplished and what my next steps need to be. I'd really appreciate emails from individuals can explain my options to help me better understand the process. I've read guides on this site (confused and scared me more) and also visa state gov sites.

what i've done:

8/10/09 sent I-130

8/13/09 uscis received I-130

9/22/09 received I-797 receipt/approval

10/29/09 received pay invoice for $70 for affidivat of support

11/2/09 entered aff of support $70 payment online

11/2/09 mailed choice of agent form(DS-3032 form)

11/5/09 $70 payment showed "PAID"

11/14/09 mailed affidivat of support form I-864 form to nvc

11/17/09 I-864 arrived to nvc

11/19/09 paid $400 immigrant visa fee online

11/23/09 payment was processed/read "PAID"

My questions...

1. Do I have to submit an I-129 form? I thought that was only for fiances. I'm married.

2. Do I received letter in postal mail or email giving me permission to sent in the DS 230 part 1 and 2 form? or by email?

3. Am I also supposed to do this K-3 visa or just continue with immigrant visa process (DS 230 form)??? How long is this taking? Am I on the right track? I was supposed to pay the fees when I did? I am now thinking that possibly I wasn't supposed to pay the $400 immigrant visa fee yet. If I did in fact pay early, does this really create any problem? I printed receipts and document cover sheet.

4. Also I read something about an OF 169 form?? What is this? Who is this for?

5. Timeframe from paying $400 Immigrant Visa Fee and submitting I-864 form to when I can send in immigrant visa form?

I thought I was on the right track and understood what I was doing. Now I'm suddenly confused and panicing. I would really appreciate a few people emailing me and helping me to understand when I am in the process and what I need to do. Thank you in advance for you time!

My questions...

You do not need to file an I-129F - in fact, it is too late for you to do so since your I-130 was approved. Ignore that form completely.

2. Do I received letter in postal mail or email giving me permission to sent in the DS 230 part 1 and 2 form? or by email?

When you pay the IV Fee bill and it shows paid, you can submit the DS230 - both parts - with the respective cover sheet printed from the website.

You're on the track for the CR-1, not the K-3 visa. Once you've submitted the DS230, it is about 10-14 days until you are finished with NVC pending no further information being requested. If you were prompted to the pay the fees, you will be 100% fine. If you did pay early, it usually doesn't cause many problems from what I have read here.

The OF-169 is a consulate specific form regarding what items to bring to the interview.

You can send in the I-864 since you already paid the AOS Fee bill - it is not tied to the IV Fee. Once the IV Fee is shown as paid, print out the cover sheet and submit the DS230.

Welcome to Visa Journey. :)

I've moved this thread from the K-3 forum to the CR-1 forum as you are following the CR-1 process right now. I've removed the duplicate thread already in the CR-1 forum as this thread had the answers posted and the other thread did not.

Sarahq, you will want to go back into your membership profile and change the information there. You show that you have filed for AOS (approved) but you really have filed for the CR-1/IR-1 visa. It will be less confusing for those offering advice if you can correct that information there so they don't get give you incorrect information.

no

maybe, is doubtful - I suggest ONLY going by the payment portal. When a payment is marked PAID, you'll see a receipt available to print. PRINT THAT, include the payment receipt with the DS-230 submittal (along with original documents )

No, not create any problem for the I-130 - as long as it's marked paid, then send it all in for the DS-230. I guess the bigger question is - DO YOU WANT a K-3 or a CR-1 Visa ? You've not submitted the I-129F yet, so with all this fast processing on the I-130 - I suggest you pitch the idea of K-3 - the CR-1 is a superior visa.

This is for a K-1 visa, I-129F petition, part of a P-3 packet. A CR-1/IR-1 visa doesn't have a P3 step, ever.

If it's marked paid already, you have receipts and coversheet, then it's time to send it. No Need to wait for a non-existent 'send us something' email. You might get one, you might not - it's not consistent at all.

So basically, you keep up with the payment portal 'status' - and send stuff in when you have a paid receipt to print. NO FURTHER WAITING REQUIRED.
