Getting Really Nervous

Timeline

I'm oh-so-nervous, and I keep trying to reality check myself.

We're dealing with a 28-yr old CIMT (stolen cigarettes - larceny).

Visited 8x on the VWP.

I'm expecting a denial, and we've prepared the waiver & supporting documents, but in my heart, I'm secretly praying for a miracle.

Somebody knock me back to reality, would ya? :(

12/7/09 - Interview (denied for 28 yr old CIMT); filed waiver same day

6/18/10 - I-601 Waiver Denied, added misrep for checking wrong box on landing card (lifetime ban)

7/16/10 - AAO Appeal filed.

8/31/12 - AAO appeal sustained (THANK YOU, GOD FOR YOUR MERCY)

10/8/12 - USCIS sent file to Consulate

11/28/12 - Visa in hand

12/10/12 - HERE AT LAST! (ALL GLORY TO GOD!)

Actually, his interview will be at about 8:15 a.m. EST. So I'll have to go to work and wait for a phone call.

My mind is so darned cruel. I know not to expect that miracle approval, and yet, my heart just hopes and prays, no matter how much I chastise myself. :blush:

i am a strong believer of miracle too,, but i have a question for you when showing up with the waive will it be granted right away or you still have to wait for that ,,, i want to including my prayer in this!

08/27/09 .- I-130 approved ( got so excited )

08/14/09. - Nvc assigned case #( after 12 long days)

08/17/09 - Ds 3032 emailed to hubby , ( Aos fee bill generated and paid )

08/18/09 - hubby emailed back ds3032

08/22/09 - Aos showed" paid "

08/22/09- IV bill generated ( and paid)

08/23/09- Ds 3032 accepted

08/24/09 -IV bill showed "paid"

08/25/09- Aos overnight

08/28/09- 864 got to nvc

10/01/09- hubby sent ds230

10/06/09- Rfe(grrrrr)

10/08/09 - resend -864

10/09/09- 230 got accepted

10/19/09 - LOG IN FAIL, FAIL,FAIL,FAIL,FAIL ( i did not even know what was going on !!!!!) MY BODY JUST FROZE IN FRONT OF THEPC !!!!

10/20/09- It is "official " per op "case complete" OMG !!!!

11/02/09- INTERVIEW date assigned , email received from nvc (Thankyou ! thankyou ! thankyou ! god!!!!!!! thankyou every one

in vj) (total of 35 working days in nvc)

11/04/09- package left nvc

11/16/09- Medical done and waiting for result

12/10/09- VISA APPROVED (slip given appointment for tuesday to pick up passport )

12/15/09- VISA ON HAND ( praise god )

02/01/10 - POE

03/02/10- Green card arrived

Thanks, everybody.

If he has to hand in the waiver, it will go to London, which has a long adjudication time. I understand that Dublin can make a recommendation as far as approval, but the ultimate decision, I believe, rests in London.

So, if a waiver is needed, we're back to waiting. Some are seeing results in 3-4 months, but I'd say 6-9 is more likely.

Actually, London is one of the fastest 601 processors out there. . . 3 months has been close to the norm for a while. . . .be glad you don't have to process through Canada, or New Delhi, or Brazil or any number of other places. . . .the only one faster seems to be Mexico if you get approved on site. . .

Yeah, it was on the PCC, but even if it wasn't, we would have been required to list it. We listed each crime he's ever been convicted of, which included a bunch of assaults from his youth that didn't show up on the PCC. Our biggest problem is the 28 yr old CIMT (stole cigarettes, which is larceny). He got a 6 months suspended sentence.

The second problem is that he checked "no" on the landing card when he visited me on the VWP. He completely mis-read the long sentence regarding crimes and thought he was honestly answering when he checked "no." To tell you the truth, I've read the danged thing countless times and it's still hard for me to understand. He hasn't been back since learning that he's ineligible for travel under the VWP. Damage is done, though, and we're both sick about it.

All I can hope for now is that the officer who reads our situation judges us with mercy & reason.

you think so? Nah, I think we'll get denied, hand in a waiver, and wait. I seriously can NOT move to Ireland, so I pray to God for mercy. I hope you soon have some resolution of your situation, Wellmux. :(

JustJ - stranger things have happened. When I interviewed in Montreal I was there with a man who lived and worked illegally in the US for 3 years and got approved with no issues. Sometimes you get good CO's who understand that we are doing everything we can to be with the person we love. I wish you the best
