Again, I ask for some help from fellow VJrs, With the I-129F, do we need to send in certified copies of both the marriage AND divorce certificates from previous marriage or just the divorce papers?

And when it comes time for AOS do we need a certified copy of OUR marriage certificate. Thanks for any help you can offer.

Yes to both questions, it states in I-129F and AOS instructions you need thos things. For AOS how else are you supposed to prove you got married so you can file for AOS if you do not supply a copy of your marriage certificate.

Thanks, yes your right of course, trying to compile all that is needed for initial application and trying to cover everything. My next question is can I get the certified copies of marriage certificate from the courthouse as I can the divorce certificate ?

That is all I saw, if divorced, need proof of divorce. In my case I sent the first three pages of my divorce decree, the part with all the relevant information making it clear I was granted a legal divorce, the date it was granted and the judges signature etc.

- 2009 Mar 28 Became engaged

- 2009 Apr 2-15 Met 2nd time in person (Syracuse-NY-USA)

- 2009 Aug 25 - Sep 25 Met 3rd time in person (Syracuse-NY-USA)

- 2009 Oct 19 Sent I-129F Application to USCIS

- 2009 Oct 30 NOA1 received

- 2010 Jan 20 NOA2 received (Approval Notice)

- 2010 Feb 4 Notified that approved I-129F petition forward to US Emabassy at London

- 2010 Mar 26 - Apr 15 Met 4th time in person (Fairfax-VA-USA)

- 2010 July 29 Fiancee had medical in London

- 2010 July 30 London Embassy Interview Date (K1 Visa approved pending a laundry list of medial stuff)

- 2010 Nov 2 Courier website shows K1 Visa packet enroute for delivery. 1st indication of final approval!

- 2010 Nov 3 K1 Visa packet delivered by courier! Visa's are in the building and in my fiancees hands! (tentative Jan 2011 arrival)

For the I-129f petition you need only divorce certificates (if any) to show each party is "free to marry" Some consulates (kiev for example) require copies of past marriage certificates to show name changes (if any) You will need your OWN marriage certificate for the AOS.

I sent in a copy of my certificate from my first marriage and the divorce decree. Both of these were requested by the attorney filing our case, her reasoning being that if you get a particularly ####### retentive processor, they want to see that there was a valid marriage to be divorced from in the first place...

I ordered my marriage certificate online, made copies and sent a copy in with the I-129F, and kept the original.

Often, women need to submit previous marriage certificates to document name changes. The I-129F instructions don't specifically mention this but the I-130 instructions DO. If the divorce decrees don't show the track of name changes, you should provide marriage certificates that do.
