Are you talking about me? I assume you are since your reply quoted my post. I filed for AOS on August 8 and the EAD was received on October 8 (2 months).

I'VE BEEN WAITING FOR MONTHS FOR THAT!!! HOW DID YOU GET IT?!?!?!

Most people have had the same "luck" as me, according to the timelines on here as of late. Like I said, your case is an exception.

What am I gonna do this??? they screwed up my application! Someone must have lost most of the package documents!!! Are we working with apes at the USCIS??? Is it because I sent it all in the same envelope, separating each form with plastic covers? Should I have sent things in different envelopes??

First, you need to take a breath, seriously. I know it sucks, but going crazy and pointing fingers won't solve anything. I should know because I've done my share of both in the past. We sent all of our stuff in one envelope as well. You should respond to your RFE ASAP. Once your RFE reply is received, processing of your case should resume.

Does make sense. They can't send an EAD if they're missing tax info.

12/20/10 ------- Received "Letter of Explanation" for RFE (Service Request to expedite my case. Called USCIS and was told to ignore that and just send in response to RFE.)

12/22/10 ------- Touch (Email for Post Decision Activity on EAD saying that a letter of approval has been mailed out)

12/24/10 ------- Received EAD in the mail

12/27/10 ------- Applied for SSN

12/31/10 ------- Received Interview letter

01/03/11 ------- Received SSN card in the mail

01/07/11 ------- Mailed out response to RFE (I-693)

01/15/11 ------- Email confirming USCIS received RFE response

01/31/11 ------- Approved!

I've heard that some people get held up at the name check.

Also, if I may, a short story. I remember working as a CSR. We'd get people calling about their insurance. Many where distraught, and a few were downright rude. Whenever they were on the phone, or just faxing us documents, you could see who were the rude ones (we receive a lot of verbal and written "here's the freaking papers you asked for, now get it done... or are you just incompetent at your job?!" Now, I'm not going to go down in details, but many CSRs took their time on cases like these... But, honestly, these cases took the longest because the person submitting whatever we needed was usually "deciding" what it is we needed or how we should proceed, even after telling them how the system works.

It's really pissing me off that you assume that you know what's up, when you don't know me at all.

Just because I am visibly and understandably pissed off right now, since a dude here got the EAD a week after he sent the AOS package - and I have been jobless for 7 months.

I have been treating the USCIS humbly and respectfully. But I think I'm starting to change because what they are doing to me is inhumane and unfair to extents that are hard to imagine.

I've always treated everyone in my life with the utmost respect.... and I'm not getting it back in this country. I'm sorry that there's so many chicanos trying to get married so they can bring their cousins. But I love my wife and I'm not here because my home country is and underdeveloped 3rd world hole, or because I didn't have "freedom". I'm here because I love her and because we can help this country get back on track. And part of the reason why it is how it is now, is because if this extremely horrible attitude of some people here, especially the religious right/republican/conservatives. And that attitude is present in the way they deal with people at the USCIS. Unless the guy behind the counter is asian or chicano - then they are nice speaking their respective home dialects. But when an english speaking European comes and they can't relate to that, I get treated like this...

Yes. And it says in the pink letter that they'll send the EAD to me 90 days after sending the RFE evidence. Thanks

So I'll just say this. I Love the fact that you begin by claiming that you respect everyone, but then you go on and on with racist and derogatory comments.

Don't talk to me like you're better than me, or like I'm demanding too much. All I'm asking is to be treated with the minimum respect and dignity that I deserve as a human being. Apparently, that's asking too much to the US immigration.

Your comments above are inappropriate. It is a violation of the Terms of Service for Visa Journey to insult or call members names. Please do not repeat this behaviour even if you do feel frustrated. Continuation of this behaviour will result in a temporary suspension of your account.

The poster in question is referring to the Affidavit of Support. According to US immigration law it IS your wife's responsibility to support you so that you do not become a public charge - that is the nature of her contract with USCIS. It is in effect until you become a US citizen, you earn 40 quarters of employment (10 years), you give up your green card, or one of you dies. It is not a matter of judgment, it is a matter of law. While your background aligns with the husband supporting the wife, USCIS views it as the US citizen guaranteeing that their non-US spouse will not take advantage of means-tested benefits until they have invested a suitable contribution to the tax base. It is not gender specific but the responsibility of the US citizen spouse - your wife- to guarantee your financial independence until the terms of the Affidavit of Support are satisfied.

My husband received his EAD about 2.5 mths after application and his GC in 4 mths - guess I knew what I was doing. I was happy to support him because he is not a sexist A_ _!!!

A Lexus - an unemployed immigrant with a spouse making minimum wage -- is that really a wise decision? How's the stress in your relationship?? Why don't you get her pregnant while you are at it?

But by the self-superior way you talk, like everyone should have money to support themselves without working, you might as well be driving one. :)

Maybe you knew what you were doing way less than us, but one of your cousins was the processing agent, and you got lucky. It doesn't really mean you deserve it any more than we do.

Alright - everyone please recognize that the OP is in a frustrating situation - he has waited 7 months so far for his EAD and his AOS - and has an RFE to which he is responding. He is understandably angry and frustrated - but telling him how quickly you go through the process and chastising him because he is angry is like rubbing salt into his wounds - it is incredibly inconsiderate and unkind. Baiting him to respond negatively is as much a violation of TOS as is making insulting and racial comments. EVERYONE - stop it!

If this thread does not resume a courteous and considerate demeanour I will be closing it. If you do not have anything useful to say, then do not say anything.

If you sent in your adjustment with an underlying I485 wherein the sponsor (your USC wife) does not earn 125% of the US poverty guidelines, then your entire adjustment process (including interim benefits like I765 and I131) are in limbo until you respond properly to the RFE.

If you can substantiate your claims (by postal receipts etc.) that USCIS delayed issuing the RFE an inordinate time, then you should cover your RFE return with a letter copied to the Director of the Service Center processing your adjustment.

Otherwise - your rage is misplaced.

PS - I know from whence I speak. My husband waited 18 months for a green card and filed for TWO EAD's during that time.

Just curious, the Employment authorization document is handled under a different receipt number from the AOS. What is the online status of the EAD? We received our work permit months before USCIS even looked at the AOS packet.

You should have received two different notices of action with receipt numbers, one for the AOS one for the employment authorization document.

Again, make an info pass appointment and inquire about the employment authorization document. It may be with the RFE it is now also on hold, may be not. But you will not know unless you First check the online status then make an info pass appointment and inquire about it.

It's not a "may be" thing. Interim benefits are not issued if there is an outstanding RFE.

You are correct he could not receive any interim benefits after the RFE was processed, But per him the RFE took months this is one of his complaints that they held his AOS application for months then sent the RFE.

His EAD should have been processed and approved prior to the RFE having ever been processed. We received our EAD and AP then six months later received the RFE for the AOS.

I still believe he should follow up on it although now, since the RFE has been sent, it may be too late.

I hope you've invested in a family sized jar of valerian - there are definitely days you will need it during the immigration process. Good luck at getting the RFE information back to them quickly. The sooner you can get it back to them, the sooner they can resume working on your file. You may still want to do an infopass appointment to find out why the EAD wasn't issued within the 3 months after you submitted the package. As Rebeccajo states, though, it is now caught up in the RFE process as well. At least the infopass appointment might help you feel a little more in control because you can actually talk to a real person - even if you don't like the answers you get.

You should post your timeline! We got the GC in three months (and the EAD a few days later -- haha) but that was several years ago now. And we got VERY lucky that they forwarded our app to Cali for teh rubber stamp. I think we filed like two weeks after the fee increase, so there was a huge scramble on the part of much of VJ at the time...

we met: 07-22-01

engaged: 08-03-06

I-129 sent: 01-07-07

NOA2 approved: 04-02-07

packet 3 sent: 05-31-07

interview date: 06-25-07 - approved!

marriage: 07-23-07

AOS sent: 08-10-07

AOS/EAD/AP NOA1: 09-14-07

AOS approved: 11-19-07

green card received: 11-26-07

lifting of conditions filed: 10-29-09

NOA received: 11-09-09

lifting of conditions approved: 12-11-09
