I´m a US and Colombian dual citizen married to a Colombian national. I have been living in Colombia for 4 years and have worked here since 2008. We are filing our affidavit of support with a joint sponsor. I am currently filing my 2008 return to submit with the joint´s sposnors taxes. I have sent my Colombian income information to an accountant in the US and he claims I must state Single status on my 1040 because my husband doesn´t have a US social security number. Is this true? Will this cause problems with immigration, since we are married and are applying for a spousal visa?

Time to get a new accountant. You are married and need to file as married. You will need an ITIN for your husband or you will need to file separately.

You can file jointly if you file a W7 to get a ITIN. The W7 has to be submitted with your return.

You can file jointly if you file a W7 to get a ITIN. The W7 has to be submitted with your return.

Exactly, file for an ITIN! Do not file single as you are not single! You can certainly file Married filing separately if you aren't reporting any income from your SO. You can also file married filing jointly

I have one more question...I'm not sure if applying for the ITIN applies to me since Im out of the country, living in Bogota and just want to file my taxes married filing separarely. We are not in the US and my spouse doesn't have a visa yet...What do you think?????

Just popped in here, as this topic caught my eye. When I filed taxes for the 2008 year, I was told by Jackson Hewitt, to file "Single". Once my husband received his SSN, then to come back and ammend our return showing "Married filing Jointly". I never even heard of this W7/ ITIN document that was mentioned here.

We did go back and ammend the return after my husband received his SSN, with no problems. Now, I don't know if that makes any difference in our case as I am only one that works (self-employed).
