October 2009 K-1 Visa filers

Sorry to hear that you also got an RFE.

Well, i finally received the hard copy of my RFE yesterday, 01/19/2010. It was actually a different error as what I suspected. It turns out, it's an even "stupider" error on my part :bonk: - apparently, i did not answer part c, question 2 of the I-129F form (if i have ever been convicted by a court of law...) :bonk:

So what I received from the USCIS were:

1) I-797E, Notice of Action (Request for Evidence)

2) Initial Evidence Request - I-129F with the statement:

"OMITTED ITEMS: The petitioner submitted Form I-129F, Petition for Alien Fiance'. However, the form is incomplete. The petitioner must answer question 2 on page 3 (attached). After the petitioner ha answered question 2, re-sign and date the attached form above the original signature and date. Return to USCIS."

3) Page 3 of the I-129F form.

So as a reply, here's what I sent the USCIS:

I-129F - Response to RFE Cover Letter with the following contents included:

1) Copy of the I-797E, Notice of Action (some people actually return the original sheet, but it's written in the back "When you reply, please include a copy of the other side of this notice and also include any papers attached to this notice")

2) Original attachment to I-797E (Page 2 of Initial Evidence Request)

3) Original attachment to I-797E (Page 3 of Initial Evidence Request) with answer to question 2, new signature and date above original signature and date.

4) New copy of page 3 of Form I-129F with answer to question 2, original signature and date signed.

5) 4 copies of my fiancee's revised G-325A with signature and date signed then I briefly explained why i am resubmitting a new G-325A as i missed a couple of items in the original submission.

Going over my paperwork again (which I have filled out on my computer), it looks like I was pretty thorough, I can't find a thing I could have missed. I'm pretty sure this is a lack of evidence RFE.

I'm glad you've got it all worked out, and I'm sure you'll be getting your NOA2 promptly! I've got everything ready to go, so if I'm right about it, all I have to do is fill out the form and pop it all into an envelope. Either way, there's no reason in the world I have to worry about it, so I guess I may as well stop keep myself occupied and not think about it too much. I just miss my better half so much that every minute this thing is delayed is a minute too long!

Aha! This is pretty minor, but I did find a stupid mistake ... and this might be it. On the g-325a form under "spouse" and "former spouses", you're supposed to write "none" and I left it blank. That would be an incredibly stupid and minor thing for them to send a request for, and that's probably not it. But they may just ask for corrections since they're sending an RFE anyway. Now ... I read some posts that said it isn't necessary for the g-325a form to be signed by the fiance. Can anybody confirm or deny this? If it doesn't need to be signed, I can just put it in the mail. If it does, then I'd have to wait like another week for me to get it back from my fiance. Please let me know if anyone has any info!

I cannot confirm or deny that the beneficiary's signature is not required in the G-325A. I do remember reading a thread regarding this though and I believe the recommendation is not to take any chances and get it signed as some adjudicators may not be aware that the beneficiary's signature is not required... or something like that... i'll try to look for that thread...

But if i were you, i would definitely get my fiancee to send me a signed copy ASAP. as you mentioned on your previous post, you just received the email today. depending on where you live, you might get the hard copy by tuesday or wednesday next week. just in time for the arrival of the signed g-325a express mailed to you by your fiancee...

Thanks for the link. I went ahead and got a corrected copy emailed to my fiance and she's going to express mail it right away. I think you're right, it's best not to take any chances. I'm not even sure this is what it's about, but I'd rather be prepared than to have to wait any longer! I figure if they picked on you for an unchecked box or whatever it was, they'd probably be more than happy to give me a hassle for leaving empty spaces. What a fun experience!

Have you already mailed out your RFE package? I'm curious as to how long it will take to get ur NOA2 once it's sent. Should give me a reasonable indication as to how long we'll be waiting, too.

Thanks for your help, I greatly appreciate it! (even just the moral support ... it's always nice to know you're not the only one!)

yep... one more day of hope for this week........

It seem like the adjucator who deals with NOA1 on the date of Oct. 13 is not working........

Hello all... I just got back from my trip to see my fiance in the Philippines Monday the 18th, we were really hoping to be approved while I was there...checking the USCIS website daily.........but.......NOTHING..... Boooo!! on you CSC !! :protest:

Anyways Im in the same boat (maybe) that a few of you are in ==> NOA1 10/13/09, first touch 10/15/09..and.........NOTHING since then....

W..a..i..t..i..n..g.. GARRRHH!!! :ranting:

By the way CONGRATS to all of those who have recieved their NOA2s :thumbs::thumbs:

and good luck for speedy solutions to those of you who have rec'v'd RFEs

(I think id be happy for a RFE at this point to just see that something is going on with our file)

Weve been tryng to call NVC number 603-334-0700 for 3 days already but number was busy all the time! It doesnt even dial... Is it the right number? Maybe are there any other ways to find out if petition left NVC already? :?

Krili, someone said that the Department of State phone number has been very busy because of the issues in Haiti. Yes, that phone number is what I have on my "cheat sheet" about how to determine when my petition gets forwarded to the embassy. (I had called at about 8 a.m. on Tuesday and it took me awhile to get through to someone but I haven't tried since then).
