Hi all,

I hope somebody can help me as I'm going to send my application this month but i got confused in some part of the questions. First, my husband was born in Philippines thru US citizen parents and by 1978 they approved his citizenship in Philippines thru a letter and i dont know what I'm going to answer on part 8 on no. 3 Information about your marital history. (Place your Spouse became a US Citizen.) Do I put Philippines?

Second is regarding prior spouse's marriage. Do I have to put the name of his ex-wife? And is it necessary to put the names of his daughters on part 9. Information about your children.

Yes you will want to put where he obtained his US citizenship even if it is in the Philippines. You may want to attach a small letter to that fact. Yes you do have to put down his ex-wifes name and any children that you have together even if they are not your children. You don't want to miss anything out otherwise USCIS could deny the application. Better safe than sorry!

06/09/10 Get RCMP certificate showing no criminal record. Fax off to senators office.

06/23/10 Approved for Citizenship

06/24/10 USCIS contacts Senators office

06/28/10 Find out that I have been approved for citizenship and they are just waiting to schedule my oath.

07/12/10 Put in line for oath ceremony....wonder how long that will be!

08/18/10 Called USCIS confirmed they sent oath letter for 09/17/2010 at 9am.

09/17/10 Oath ceremony at 9am..... US Citizen!!!! Applied for passport.

The word "your" on the N-400 refers to the person applying for naturalization (see the grey heading for Part 1). When it asks for your children, it's asking for the children for whom you, the person applying for naturalization, are a parent. Your spouse's children don't count if they are not your children, too.

As for your spouse's citizenship, it's unclear to me exactly what his situation is. Note that the N-400 only asks where your spouse became a citizen if he did NOT become a citizen at birth. If he became a citizen at birth, you don't even need to answer that question. If he became a citizen because he was born abroad to US Citizen parents, he has been a citizen since birth (even if he received the final paperwork much later).

If he has a consular report of birth abroad showing he was born a US Citizen, then he's been a citizen since birth. If he has a naturalization certificate or certificate of citizenship that shows he became a citizen at some point after he was born, then use the date and place as written on that document.

You have to provide proof of USC for your spouse if applying under the three year marriage law, birth certificate, copy of US passport, or certificate of naturalization.

It's in the N-400 instructions to list all of your children, natural, adopted, and even step kids.

Our attorney strongly advised us to list the United Way and American Red Cross as fund raising organizations, I really don't know if they are involved in communistic practices or not. All I know is, the only way you can get them off your back is to give them a couple of bucks.

I see on the latest form, still asking this question:

"How many total days did you spend outside of the United States in the last five years."

Wife had a dispute about that with her IO as we answered that question exactly the way it was asked. It did not ask since you became a LPR, it asked in the last five years. So that is what we put down. The way the N-400 is very poorly written, can always expect some kind of a dispute, it's their form, not ours.

Can only wonder if voting for other than an incumbent is means of overthrowing the government.
