Hello Fellow VJ's

My brother file a I-129F K1-Visa. His fiancee had her interview but she fail. They gave her a 221(g) fail slip and the reason is because they feel the relationship is fake. My brother has email and called the embassy multiple times but all they would tell him is "The case was sent back to USIC" it has been 6 months and the USIC still haven't received it. Is there anything he should do? What should he do?

Please help!

is that the only thing the 221g said? did they ask for additional evidence? what part do you mean she failed? did she not know the basic answers to the questions? first advice is to contact the senators and see if the case is actually still in cambodia, which will be the best case scenario. the next step is to contact a reputable immigration attorney with experience and documented evidence that they have been successful with returned petitions.

My brother show me the letter that the Department of State of The United States of America sent him. On the letter it said:

"Section 221(g) which prohibits the issuance of a visa to anyone whose application does not comply with the provisions of the immigration and nationalily act or regulations issued pursuant thereto. the following remarks apply in your case:*

Your case is being returned to USCIS for possible revocations or reaffirmation, base on the information obtained during your interview process that has caused the interviewing offer to believe that your relationship with the Petitioner is a sham, entered into solely in order to provide you with an immigration benefits to which you are not entitled."

They are saying they do not believe that you have a bonafide and ongoing real relationship.

What was the evidence of such that you sent in your original petition?

What evidence was presented at the interview?

What questions were asked at the interivew and what were the answers?

it may be time to consult a good immigration attorney. if he is going to refile, he has to prove their decision was wrong. it will be a long process to say the least. my husband's original interview was on november 12, 2008, so next month it will have taken a year.

since i do not know why they think it was a sham, and for immigration purposes on your brother's case, this is why i say get an attorney. some people recommend marc ellis (ellis-island). i did not retain him, but he was very helpful in advising me what our options were. good luck to him :thumbs: it is devastating (to say the least).

so unfortunate... please make sure your brother explores all his options. Above posts are on point; re-check his evidence and make sure he has ALL the evidence he can gather, no matter how small or irrelevant HE thinks it is... this could prove useful

Luckystar09 - sorry to hear about the hick-up of your brother's case. Would you happen to know what kind of evidences or lack thereof that lead the immigration officer to deny a K1 visa to your brother's fiancee? My wife is having an interview in 4 weeks or so and it would be helpful to know what kind of evidences immigration officers are looking for.

Easiest and fastest and cheapest is to file another I-129f petition and prepare his case and his fiancee next time. Waiting for an appeal will take longer than filing a new case.
