I just need to know how I'm supposed to visit the U.S. while waiting for our case to be complete.

Will that mean I don't need to get any visa and just show up there with proof that I will return to my home country after a few days of seeing my fiance?

Another option is to secure a tourist visa but most people say that single women have lower chances of getting approved for a tourist visa. If I secure a tourist visa and get married in the U.S., do I still need to return to my own country and start filing a CR-1?

It's now September 25 here in the Philippines and that's a month from the date of our NOA2 but the NVC still tells us that they have no record of our case.

If they would be telling us very, very soon that our case is moving to the Consulate, that could change a lot of things.

You and everyone else. We tried for visitors visa and were denied. Partly because of our pending case. Unfortunately unless your passport is from a VWP country you will probably have to wait. Please accept our empathy as it is a hard road but it was worth the wait for us. Good luck.

This is the time to contact your representative. See the worst wait is over and that is the NOA2. Just hang in there I am sure you will hear something.

like what others have said, you can take a chance and apply for a tourist visa, but check out the requirements first if you can fulfill them, if not, might as well just wait till your petition is approved and you become eligible to apply for a fiancee visa.

why are most tourist visa applications of single women who have a pending K1 petition denied? precisely because many of them have the same plan as you, - to get married while in the states, thinking it will make the process a lot faster.

if anything, your attempt to go to the US might just cause peoblems on our K1 petition/visa application.

it would be safer for you to just wait till you are approved.

You WILL need a visa to enter the US. The Philippines is not a Visa Waiver Program country. In all likelihood, you will never get a boarding pass to get on an airplane without a visa.

The chances of getting a tourist visa are not good. The fact that you have a K1 visa application in process establishes your immigrant intent. Given the backlog of applicants from the Philippines, it's highly unlikely that the CO would believe you would come back before your tourist visa ran out.

If you DID manage to get a tourist visa and then got married in the US, then your K1 petition would be void. You'd have to start over with the CR1 from scratch. If you decided to stay in the US after marriage apply for AOS you would likely be denied, and then banned from the US for misusing the tourist visa.

Getting denied for a tourist visa is not supposed to have a negative effect on your K1 application. However, some consular officers have admitted that they are suspicious when an applicant has had unsuccessful attempts at getting a non-immigrant visa, and then show up for a fiancee or spousal visa. This may only be if the tourist visa applications happened before the K1 petition was submitted. Who knows how a CO really thinks... :blush:

There's no excuse for USCIS taking a month to get your petition to the NVC. Something is very wrong. If I were your USC sponsor, I'd be rattling cages at my congressman's office, my senator's office, and calling USCIS several times a day.

I agree with Zen Den, it would be best to wait.

It was so easy for me to get a tourist visa last year but unlike you, I didnt have a pending K1 visa application. We filed the K1 application 3 months after I got the B2 visa.

You are in NO2 already, you are almost in the finish line.

Just hang in there.

hello sis.. its true like others said my tito also told me this i cant apply for tourist visa bcoz i have a filed petition... tell hubby to visit u here hehehe... regards and goodluck... :star::thumbs::dance:
