I'm not 100%, so don't quote me on it. But I would include a translated copy of your husbands Brith Certificate. This is so you can try to avoid a RFE (Request for Further Evidence)

If the documents aren't translated, you are going to need to get them translated. Echoing IT_1, read the instructions, but once submitted, get them translated

Your husband will need the translated birth certificate when he goes to the US Embassy for his interview. It is not needed for submission to USCIS. You can find that on the K3 Guide: http://www.visajourney.com/forums/index.ph...mp;page=k3guide

The petitioner may either present his/her birth certificate, naturalization papers or his/her passport pages as proof of their citizenship. Only photocopies will be required by the USCIS.

ANYTHING you submit to the USCIS needs a translation if it's not already in English. See the USCIS general guidelines page. Look for the word "translations" on this page:

The reason is that the USCIS officers handle documents from all over the world, and they're not fluent in every language. The only language you can count on them understanding is English.

So if you're not willing to get a translation or do one and certify it yourself, then don't send the foreign language birth certificate to the USCIS. People have reported getting RFEs requesting translations for foreign documents that weren't strictly necessary. But since the USCIS officer won't know what the document is, and the officer is required to read it if you submit it, he'll probably request a translation so that he can read it and figure out what it is.

If you wait and submit it to the consulate in the foreign country, you'll go by their rules, not the USCIS rules. Consulates vary somewhat, but most will accept anything in the official language of the host country without requiring a translation. That's because consular officers only deal with one country, and they live there, so most of them are already fluent in that language. Check with your consulate to verify their translation rules before relying on that, though.

The alien's birth certificate isn't strictly required for the I-130 submission. But if you DO send the birth certificate, be sure and include a translation. Sometimes when the birth certificate isn't included, it can be requested, for no apparent reason. Usually it won't be requested. So the safest thing to do is to send the birth certificate along with a translation. The second safest thing is to send neither the birth certificate nor a translation. The most risky thing to do is to send the birth certificate without a translation.

I filed for a K-1 so I didn't need to send a copy of my his birth certificate. You will be interview at the Juarez Consulate which as long as the documents are in either English or Spanish you do not need to translate them. Hope this helps.

I also have this question about birth certificate? I am going over the I-130 instructions and it seems you dont need to submit beneficiary's birth certificate with I-130 . But I need confirmation of that as I consider myself new to this process.

Can anyone else respond to this?
