We got through our interview and was told we have a legitimate relationship but we couldn't be given a green card because of an outstanding warrant from her country. It turns out her family filed bogus theft charges after she refused to go back home with her brother when he showed up one month AFTER she left. We know that we have to get this warrant dropped or apply for asylum. My question is this : has anyone had or heard of a similar experience who ended up using different options. Her family does not want to let go. No guilt trips please. We have been married for 8 months.

Yes....she is Emerati......and I don't know bout the fine.....I really doubt they would accept it because the sole reason these charges were filed was to force her out of this country (USA). I know this....because her family has been here knocking on our door 3 times. Was even thinking of sending them money to cover these alleged losses.....but they are claiming 50,000 USD was stolen. Would love to hear how much money people have come in with.....I just don't think its possible to come through a port of entry with 50K on your person.....I know it would be impossible to put it in a bag........bags are all searched and x rayed...etc.........local police said they got a call that there was a 200,000 dollar bond on her. I suppose the caller was hoping that would make them go pick her up. They checked into it and its a Federal matter...... and no extradition treaty with UAE for such a thing. THANK GOD. !! A friend of hers said that this is normal when Emerati girls leave the country without their parents consent. For the life of me I just can't understand why the government allowed her to leave in the first place....if they are going to go through this much trouble to get her back. Have been to Dubai 3 times and am in shock that they now act like a totalitarian government when a citizen wants to leave. Salam alakim

Ouch. You're in a pickle. A lot of people make the mistake of thinking the UAE is just a playground for the rich. Well, it is that on the surface but it is also much like Saudi behind the scenes. Especially for Emirati women. They even have secret police that are there to enforce segregation of the sexes for Emiratis. I don't see the authorities in the UAE ever going against an Emirati family for the sake of a non-Emirati guy. I don't think you will be able to settle this in the UAE. You should contact some kind of women's/human rights organization as well as an immigration lawyer and explain that her family is trying to keep her from being married to who she wants. Explain to USCIS that the family is trying to kidnap her back and that she did nothing wrong and ask their advice about what to do. Maybe she could file for asylum. At the very least you will need an immigration lawyer. Good luck. Hope you can sort it out.

And yes, US customs does thoroughly search luggage for more cash than is allowed. A person is only allowed to bring in $10,000 undeclared. Any more than that has to be declared and like I said they check the luggage. When I flew home to the US for a visit they asked if I had more than $10,000 in cash on me and I said no. They still took me to a back room and opened and searched every inch of every suitcase and bag I had with me looking for cash specifically and any other banned item as well. And there is nothing about me that even looks remotely suspicious either.

So, you are filing for AOS I am assuming? You said her family has knocked on your door 3 times? Are these brothers or extended family? Are the parents who filed the charges here in the US?

I agree that some sort of human rights organization might be a good place to start, along with a good lawyer ??

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

I'm surprised that she was able to leave the UAE to come to you, but not at all surprised that her family will do anything to force her back. We discussed this before, Denny, and I warned you that she was being reckless in light of the laws there. The UAE will never recognize her marriage to a non-Muslim, and, if she goes back, she may likely be in danger. You need a human rights lawyer who is specifly knowledgable with the UAE to get asylum for her. I doubt you can fix this any other way. Unfortunately, she may still be in danger here,too.

yes to the AOS after marrying her here. And yes to the brothers on the doorstep and her mother. No....family does not live here....but they have no problem getting here.................this is a warrant out for her arrest in Dubai that Interpol has picked up. This question was started because before she came here my lawyer said that that worse case scenario he could keep her here by claiming asylum. The problem is.....he didn't see this warrant coming and he just wanted to look at other options before doing that.......am getting the feeling I might need another lawyer ! Maybe we should just ask if he is up for this or not.....he is making me nervous.

So sorry to hear about your situation, but it sounds pretty dangerous. A human rights lawyer may be the way to go...
