I am a naturalized US citizen and has filed bankruptcy recently. I do not have a job right now...and I am in school (graduating next year and with student loans).

My girlfriend has an L1 visa. She makes more money than I used to. she makes more money than my parents!!!

How will my bankruptcy affect if I want to petition my girlfriend for a fiancee visa? What should I do to get her a fiancee visa?

Thanks :)

Your bankruptcy probably won't have any effect at all. However, your income probably will.

At the interview stage you're going to have to submit an affidavit of support. If you don't have enough income then you'll probably need a co-sponsor. The minimum for a household size of two (you and your fiancee) is $18,212 per year. Add $4,675 for each additional dependent.

The only thing I'd add is that if your "girlfriend" is going to be your fiance, or you want to marry, it appears you can do so while she's in the US on a L1 visa. This is what I googled. Something you might want to look into rather than doing the fiance's visa.

An 'L-1 visa is a visa document used to enter the United States for the purpose of work in L-1 status. It is a non immigrant visa, and is valid for a relatively short amount of time - generally three years. L-1 visas are available to employees of an international company with offices in both a home country and the United States, or which intend to open a new office in the United States while maintaining their home country interests. The visa allows such foreign workers to relocate to the corporation's US office after having worked abroad for the company for at least one year prior to being granted L-1 status. The US office must be a parent company, child company, or sister company to the foreign company.

Spouses of L-1 visa holders are allowed to work, without restriction, in the US, and the L-1 visa may legally be used as a steppingstone to the Green Card under the doctrine of dual intent.

do you want your "girlfriend" to go home and get a visa only to come back or would you consider marrying her and having her stay here the entire time until greencard?

YMMV

Bankruptcy doe snot affect the visa. Your lack of employment may require you to get a co-sponsor.
