Hi,

I have my K1 interview in London on Friday.

Given the nature of the K1 process, I'm guessing our situation isn't that uncommon. We came to a mutual decision to file the I-129F without a formal proposal happening.

After the I-129F had been filed, I made a "proper" job of proposing the next time we met face to face.

So my question is this,

If I am asked at the interview when we got engaged/I proposed, will it raise any eyebrows if this is after the I-129F filing date, given that it's meant to be a peition for a "fiance"?

Thanks in advance,

Adam

Well......getting engaged and proposing are two different things in the long distance relationship world as I see you know!

If they ask you when you got engaged then give the date you decided that you'd get married (which is obviously BEFORE you applied for the K-1). If he asks you when you proposed then explain that the two of you official decided to get married on XX/XX/before K-1 but that you were apart at that time so you officially proposed on XX/XX/after K-1 and in this way...blah blah blah.

Just be honest. They know that many of us don't propose in the conventional manner. But it's best to not confuse them and if they ask to just be honest. But be clear that the two of you WERE ENGAGED before the K-1 was filed as that is a requirement of the visa (remember those letters you signed way back before USCIS that said you swore to get married within 90 days of entering...if that's not an engagement then I don't know what is!).

Excellent - This is what I thought and I guess I was just looking for some reassurance as the nerves are starting to set in :D

Thanks for the quick response,

They don't care when you got engaged or when you go down on one knee or presented a ring or if you ever presented a ring at all!

Don't worry. And you don't even have to make up a date! If they ask when you go engaged you can just say "March 2009" and they would be fine with that. And there was a point when you and your fiance(e) talked about getting married because at some point you weren't applying for the K-1 and then you were. So whenever you decided to apply for the K-1, that's when you got engaged.

Your case is pretty standard, and as long as you are honest, it does not matter. You don't even have to be "formally engaged" (in some cultures/religions there is a difference) and no proposal need ever have happened. If they ask, what they really want to know is how and when the couple decided to get married, the relationship is legit, and that you intend to get married within 90 days of the non-USC's entrance into the US. A proposal is the standard, western way to do it, but it is not required.

Being engaged is not a requirement for the K-1. Yes they may ask and you should just answer truthfully. The only thing that you must promise to is to marry within 90 days of coming to the US or you go back.

I don't think it would matter really, but seeing as how you signed your I-129F stating that you were "Fiancee and Fiance" (ie... engaged) then if asked, I'd just use a date you both decided to go for the K1 - ie, before you signed it! I'm sure it wouldn't matter much, but if you get interviewed by a real stickler for the rules who had an argument with his wife before leaving for the office that morning... who knows. if I were you, I'd forget about the day you got down on one knee and 'did the deed' - Good Luck!

When you both talked about filing for the K-1 visa, did you talk about that you both needed to marry each other within 90 days of entry to the US?

If you did and you both agreed to that, you both proposed and became engaged. No ring or kneeling down required.

Adam,

London is pretty easy going on the relationship proof side (low fraud), so don't get too worked up.

They DO typically ask how and when you got engaged, but it is a fairly conversational interview. Just explain as you did here, and I'm sure it will be fine.

Good luck!

Like it or not, when you both signed letters of intent and sent them with the I-129f you WERE engaged. It is not the fault of USCIS that you took some additional time to figure it out and actually ask her! :)

No. Rings mean nothing to USCIS. When he actually proposed means nothing to USCIS. The ONLY thing they care about is that the fiance(e) letters of intent are signed by both. Alla never did (and still does not) have an "engagement" ring. Such things not being a big part of FSU culture. She has only a simple wedding band we bought AFTER she already arrived here.

You girls are going to have to think of another excuse for your fiance to buy the ring you want!
