I submitted N400 application to lewisville TX on 13th July 2009. USCIS received the application on 15th July. I received the complete package back: my N400 application, photos, green card copy, and check from them on 20th July, 2009. The reject notice receipt has date as 16th july, 2009. The USCIS send back the application, since I forget to sign the application. The reject receipt notice specified to re-submit the application.

I did a silly mistake by attaching second check to the re-submission application. Send the re-submitted application to USCIS on 23rd july, and the USPS delivery date shows as 27th July 2009. Until, did not received any receipt notice for the re-submission, and neither check is cashed. Called USCIS 3 times, since yesterday, and they just told to wait for more time.

My frnd, and her wife applied N400 on 29th July, they received the receipt notice on first week of august, and also their check was cashed. They got finger printing, and they took FP today.

Now, USCIS has 2 checks of mine for one application, and their is on information in their system, except the 16th july reject notice for re-submission.

pls suggest what I need to do:

1). do I need to wait some more time, calling my bank to not clear both the check, and keep hold on it

2). do I go ahead, and resubmit the N400 application with new check with new bank institution new check

beside what other options I have.

Make an infopass appointment at your local USCIS and speak with an immigration officer to see if they can provide you with some advice. You can make an infopass appointment at http://www.uscis.gov , select 'Schedule an appointment" from the right hand side and follow the directions.

I hesitate to say to cancel the second cheque but you certainly don't want them cashing both. Good luck.

Definitely make an Infopass. But, don't stop any of the checks unless they tell you to! My application got rejected as well and I had to resend it and they ended up only cashing the check they kept (the one with the resent app), not the first check they send back to me, even though the first check LOOKED cashed, you know, with stamps all over it and such.

Yes the application was sent to correct address. The USPS tracking number shows, the application reached to correct address on 27th July 2009.

what I did see was when they send the package back to see, there barcoded lines on the left had side in the application, and also for the check fee.

Usually once they receive the application, how much time they take to cash the check. The re-submission did not show in their system as entered yet, as based on the information I got calling the USCIS customer service. They stated that on my name, and there is only one entry for N400 application, which was only for reject notice.

I was thinking to keep stop payment for only 1 check out of 2 checks send to them. Is this recommended

Thanks to all the responses for suggesting me to follow, and make an appoitment with infopass:

Here are the step I am going to follow based on the suggestion provided by the replies:

1). Immediately making an infopass appoitment with the reject notice number for first application, I have

2). Not stopping any check payment

3). Taking proof of USPS as delivery confirmation

I want to thanks all the members replies, and time, since I am not aware at all the INFOPASS feature is available yet.

I will keep you posted the update

heres my own senario and just check if this could help you... last May of this year i file a I-90 application for GC renewal. a week after i mailed in my application i found out that they changed the address where the application should be filed... i use LOS ANGELES address which is their previous address and just to found out they changed it to PHOENIX ARIZ.

without having second thought i decided to make a stop payment on that check and was thinking that im just going to mail a new application to the right address which is in ARIZONA. while i was finishing up my second application, a notice from lockbox Phoenix Arizona arrived that they got my application and a receipt number... i USCIS callcenter but they cant help me unless they can see a status of my application online. 2 weeks after, i called the same number again and they forwarded me to finance department and they lady that i talked to was telling me that THEY WILL JUST MAIL ME AN INVOICE STATING HOW MUCH I HAVE TO PAY w/ $30.00 penalty because of the stop payment, they said that i just have to follow the instructions on that invoice and should pay within 14 days.

2 weeks later, i called again letting them know that i havent received any invoice yet, and the lady from finance department just told me that the invoice is on the way.... that i could make a phone payment through my DEBIT card a week from that call.

while i was waiting for my invoice, a letter for my fingerprint appoinment came, now i was soooo worried knowing that i havent paid a penny and now they are still processing my application, i made an INFOPASS TO SAN BERNARDINO BRANCH and the officer was advicing me to just mail a new application. i called finance department right away and telling them what the immigration officer has adviced, and they adviced me not to do that, which will just complicate things more.

i made a phone payment and still went to my finger printing.... just last week i got a letter that they are on the process of my card's production...

so i would advice you to call that 1-800-375-5283 hotline and ask them for the finance department number and call them... they should tell you whats going on with all your checks....

but i was told that when you mailed a check to USCIS as long as they cashed it, there's no refunds...

May 05, 2010 - iv bill shows "PAID"

June 24, 2010 - sent AOS via USPS/certified and prioritized

July 14, 2010 - received RFE. nvc is requesting again for Tax Transcript 2009

Sept 14, 2010 - Mailed RFE documents via usps

Sept 22, 2010 - mailed complete DS-230 via DHL

Oct 14, 2010 - received RFE about beneficiary's police clearances

Nov. 30, 2010 - sent corrected DS-230 with correct years of residency via USPS

Dec. 21, 2010 - CASE COMPLETED!!!

April 28, 2011 - interview date was set to JUNE 28, 2011 @6:30AM

June 15, 2011 - MEDICAL EXAM and will be back fri (6/17/11) for results

June 28, 2011 - Interview

July 12, 2011 - arrived at LAX - and we'll live happily ever after!

Thanks for your own scenario mitch. I will call the USCIS customer service number, and get the finance department contact, and will talk to them. I also scheduled INFOPASS with washington dc field office on 3rd september. I did see the USPS delivery confirmation to right address on 27th July, and since check is not yet cashed, and also I did not received any receipt number yet almost nearing to 30 days, I am not sure what happened to the complete package. I did keep a letter stating that if the first check which has thin ink barcode at left side is not able to process, then only pls use the second check.

I hope they will not cash both the check, or I was thinking to keep the stop payment on second check with my bank institution, so that they can cash only once.

I will update after talking to finance department.

The only good point I got from your scenario is that their is no harm keeping stop payment with USCIS, and just paying them the penalty. I was recently victim of identify theft, and has proof to show them that I kept stop payment because I did not heard from them since past 30 days with no communication, and no cashing the check.

thnks to everyone for providing me with suggestion. Based on the reply to get the USCIS Finance department number from the USCIS customer care rep, I got finally a good 2 tier rep, who took care of the issue by opening a service ticket number, and told me that I will get letter within next 30 days regarding the service id, and what happenned to the application. She took the USPS tracking number, and feed the info in the service id number. when I told her that I mailed them 2 check, then she told not to worry since USCIS will only cash 1 check at any given point of time. She also kept the 2 check details in the service id number.

She told me that if USCIS will not able to locate the application within next 30 days based on the service id number, then they will mail the letter to re-submit the application. While re-submitting the new application, I need to put the letter as attachment.

I appreciate all the folks who replied to this thread with tons of info, which I never know.

Now, I am relaxed, atleast there is service id in place to track what happenned to the application

Finally, I got letter today from uscis for the service id request opened on 27th august. The letter states that they did not find any re-submission application for the date received from usps, so asked me to re-submit the new application with new fee. They also specified that since they do not have any application received on their side, in future if suppose they cash the check, they asked to keep the letter as proof. They also specified the question of cashing the check is ruled out, since they do not have my re-submitted application on 27th july, as showed by usps.

I am all set to re-apply, and probably use ups service/fedex service this time, to make sure prompt delivery.

I want to thank all the folks who replied to this thread, and without their help/suggestion, the resolution outcome of my issue was not possible.

I am happy that everything is ended in smooth manner.
