First,let me tell you my short story....

I got married to a Citizen in 2006 of May..Started the petition in June 2007 then finally got here in US August 2008..by the way,my visa is under CR1..anyways,I got my SSN and Green Card 2 weeks after I arrived in US but me and my husband was confused coz they gave me the 2 year GC..we thought that I was supposed to get the 10 year GC coz we're 2 years married before I got here in US..I've asked some people already and they all told me the same thing..I WAS SUPPOSED TO GET THE 10 YEAR GC...but the thing is,no one really actually tell us where and who we should call..a friend of mine said that DHS is whom I should call but she's not sure though...Can anyone here tell us what we should do?

You can make an InfoPass appointment to speak wih someone face to face. My understanding is that issuance of the conditional or 10 year GC is up to the CO at the embassy.

Since you hadn't been married for 2 years at the time of the application for the visa, then you correctly applied for the CR-1 visa. With a CR-1 visa you are a Conditional Permanent Resident and your Green Card is only for 2 years. 90 days before that visa expires you have to apply to Remove Conditions on your residency and if approved then you are granted a ten year Green Card.

We haven't made it all the way through that process yet, but this is my understanding.

Time Line

2007-11-10.....Marriage in Ecuador

2008-01-11.....I-130 Sent

2008-04-28.....I-130 Approved

2008-05-02.....NVC Received

2008-08-20.....Case Complete at NVC

2008-10-14.....Interview--221g, asked to present joint sponsor inspite of NVC approval

2008-11-07.....Visa due to arrive. DHL truck delivering visa was robbed, Consulate required us to present I-864s and DS-230 again, had to get a new passport and other related documents

2008-11-14.....Presented all new documents in person at Consulate, visa printed same day

2008-11-25.....POE Atlanta

2008-12-26.....Green Card and 2nd Welcome Letter arrive

2010-09-02.....Date of NOA ROC 1-751

2010-12-13.....Approval of ROC

2011-01-12.....10 year Permanent Resident card arrived

2011-12-20.....N-400 Application mailed

2011-12-29.....NOA

2012-02-02.....Walk-in biometrics (appt was for 2/16)

2012-04-17.....Interview

2012-05-18.....Naturalization Ceremony

You should get the 2 yr conditional green card if you were married to ur hubby for less than 2 yrs. 10 yr gc if you been married to him for more than 2 yrs..correct me if am wrong pppl.

" Your permanent residence status will be conditional if it was based on a marriage that was less than two years old on the day your green card application was approved. Your permanent resident status is conditional, because you must prove that you did not get married only to to get a green card."

I think yours is a mistake. Your GC is supposed to be 10-year one. USCIS makes so many mistakes like that. Sometimes reverse situation happens which is another mistake, I mean you are supposed to get 2-year Conditional, but you get the 10-year one. It even happened here to one of VJ members.

Anyway, the best thing to do for you right now to write your situation to NBC in Lee's Summit, MO. Good Luck !.....

Differences Between IR1 and CR1 Visas

IR1 (IR stands for "Immediate Relative") Visas entitle their holder to receive Permanent Residency within the United States for a period of 10 years (may be renewed)

CR1 (CR stands for "Conditional Residency") Visas entitle their holder to receive "Conditional" Permanent Residency within the United States for a period of 2 years

The deciding factor on which visa an applicant is issued (IR1 versus CR1 visa) is the amount of time that they have been married at the time the visa is issued. If an applicant has been married to their US Citizen spouse for a period of two years or greater they will be issued an IR1 Visa. If they have been married less than two years they will be issued a CR1 Visa. A CR1 Visa will result in the applicant obtaining "conditional" permanent residency within the US and after a period of two years the applicant can apply to "Remove Conditions" 90 days before the conditional permanent resident card expires and they will be issued a regular 10 year green card.

If the visa was issued after May 2008 (two years of marriage) then it should have been an IR1. However that was over a year ago, so they may not correct it at this point and tell you to apply to remove conditions to get the 10 year card. I would also suggest an infopass appointment to talk to a person face-to-face.
