K1 queries Please help

Hi.

I'm a 24 year old male from N.Ireland and have been seeing a 20 year girl from Indiana for about 2 years now. I have been there 3 times, twice for 2 weeks and once for 2 and half months and she has been here twice in the last two years. On my last trip (the 2 and half month one) we decided to get engaged. We want to go through the k1 route but have a few worries and queries.

Since the age of 18, when I have left school I have not had employment or drawn benefits. This has left me with no credit, tax or job history and we were wondering would this affet our process for a k1...? We have relied on both our families in our relationship.

Also, since we have only really looked into the k1 process this trip we only have some evidence of our relationship relating to this trip. I kept my boarding passes for the flights home, a few receipts, tickets that I had for a concert, movie stubs and thank you cards from her family to me and my family and of course my passport stamps and hers for coming to Ireland. We also have dated photos of all our trips. We also have emails and a couple of letters she gave to me while I was leaving. Is any of this evidence good? How do the receipts show that I was there? After all, they could be hers as they were paid for in cash...

My last question is, for three years I lived at another house while still keeping my parents address as my mailing address and was registered at this address for the electoral roll. Do I need to put down this other address and also get a police report for it?

Any advice is much appreciated

Not sure why you thought it was a good idea to do nothing for 6 years, but unemployment/lack of employment history is not per se a reason for denial. Depending on the adjudicator (at both the I-129F and K1 phase), s/he might scrutinize you more carefully; but, as long as everthing comes out clean, you should be ok.

Also, since we have only really looked into the k1 process this trip we only have some evidence of our relationship relating to this trip. All you have to show is ONE meeting in the last 2 years. So your "this trip" receipts etc. should be fine. Presumably you also have passport stamps for each entry to US or her entry to the UK. Read the guides and explore the forums and they will show you that you are not without evidence.

Do you have income (your own) coming in now, IE a job?

If you do not - you should start planning on that - or line up a co-sponsor.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Yea im looking but her mum will be able to sponsor me. Im just scared they will think my lack of employment since school is suspicious. Truth is I was able to get by with helping my family and such and savings as a kid.

The beneficiary (Guy from N.Ireland) does not need a job.

The petitioner (girl from Indiana) will need a job with sufficient income, or assets, or a cosponsor. That comes later, but is good to know about/plan for.

I believe that the sponsor has to be a US citizen/LPR, so don't think his mother sponsoring him will work out, unless she gives him the assets in his name to self sponsor. (London has let others do this - assets only)

Can't really answer that. Technically, it shouldn't, but the case is up to the CO looking it over.

At the embassy level, they are looking to see if you have the chance of becoming a public charge, so they will weigh that into the decision. However, they mostly look at the petitioner, not the benificiary.

Will your wife to be working? Or is she still taking money from her family? (but since her mom said she will sponsor you - shouldn't be an issue)

from my own experience you dont need a job..they wont ask for your income or why you diddint go to school....you will give them any information you have..like they asked my fiance the last 5 years were she lived and the schools she attended since elementary school...the job and co-sponser was on me since i am the USC my sister co-sponserd and she will be the one to give all the tax and employment info....

i really dont kno why but i kno they require it on the g-325a and then the school information leter in the process on the DS forms

Thats usually, from what i understand, for people who have lived in multible countries as you need to provide police reports if you have lived in a country for more than six months. I moved around in college etc but i put down my home address and that is all they needed. It was the same address provided for the police report.

October 2006 - Met in Houston

January 2007 to November 2007 - Dating and lived together

1/30/08 - Sent I-129F to VSC

2/5/08 - NOA1 received

2/24/08 - Touched

3/14/08 - Approved!!!! 44 Days

3/19/08 - NVC Received

3/21/08 - NVC Sent

3/25/08 - Consulate Received

3/31/08 - Packet 3 Received

4/01/08 - Packet 3 Sent

4/07/07 - Packet 4 Received

4/08/08 - Medical

4/28/08 - Interview!! 89 days Visa Received

5/14/08 - Entry to US, Woohoo

6/06/08 - Wedding!! Bigger Woohoo

6/22/08 - AOS and EAD Filled

6/27/08 - Noa both received

7/16/08 - Biometrics Appointment

7/22/08 - AOS transferred to California

8/22/08 - EAD Approved

8/28/08 - AOS I485 Card Production Ordered, WOOHOO

9/02/08 - EAD Received

Sept 08 AOS Recieved job got the week after!!

Your fiancee is the LPR applying for your K-1 visa. It is she that must provide sponsorship and in this case it sounds like her mother will need to provide the necessary documentation. You should review the poverty guidelines with your fiancee to insure that her mother will qualify. I hope you are on good terms with your soon-to-be mother in law.

As far as you not having a job, that will only concern the embassy people regarding whether you might become another person living on public assistance. The best thing to do at the embassy interview is ask them how soon do they think you can begin working to help your fiancee finish her school and the two of you can think about starting a family. You want to leave an impression that you are wanting and willing to work and not just looking to be a free loader.

As far as the multiple addresses, that is stated before, for the police clearance. It generally is not a problem.
