Hi guy,

Bit of a weird question for you all. My fiancee and I are just about the mail our I-129f so we're just starting out on the road to K1 approval. Now I am her UK fiance, she's a US citizen, when I am given the visa and approved to move to the US, can I wait a few months or do I have a certain time frame to go or what?

I am not positive on every U.S. Embassy K-1 visa validity date, country specific, but I believe i heard it is 6 months across the board.

In this process, it is wise to perform due diligence on significant matters such as this. If I were you, I would first, check the U.S. Embassy UK website. If that yields no information, call the Embassy.

The members here are available to help, but it is always best to hear it from the "source" on significant matters.

You must move to the USA within 6 months of the visa being granted. There will be an expiration date on the visa.

When you actually get the visa it has an expiry date six months in the future... you can use it any time before it expires.

6 months will be plenty of time!

One other thing... The Nebraska Service Centre, where we have to send our I-129f, do we sent them the I-134 Afidavit of Support as well in the same envelope?

I've also heard that Nebraska don't deal with the I-129f anymore too.... is this true? Will this get transfered to another Service Centre? Will this delay our whole application for the K1 visa for myself?

You still have to send it to NSC but it will be transferred to CSC. The I-134 is not until packet 3 so don't worry about it yet! It's only a few days difference. Be sure to use the newer 129f though, to avoid getting an RFE.

hiya Phil - the visa is valid for upto 6 months from what I hear, so you have to travel within the 6 months of the issuance of the visa. One time only entry to USA. When you enter you marry within 90 days and stay there till you adjust status - if you wish to come back to UK before you get your temp green card/green card you will need to file the paperwork allowing you to called advance parole:) How was your trip to states? or are you still there?

The K1 Visa is good for 6 months, until you enter the US. But once you enter the US, you have 90 days to marry. Not 6 months! Don't play with it, use it. You waited forever for it!!

We downloaded the I-129f from the USCIS website. It's got at the top that it expires 12/31/06. At the bottom of every pay it says Form I-129f (Rev. 05/23/06) N.

Is this the new I-129f form?

How is this form different from the previous I-129f?

Why would i get an RFE?

Basically a new law was passed and they didn't update the I-129F in time so they had to delay the process further buy mailing everyone a one page form. So download the newest one with all the required info so you don't get the RFE with that one page. It'll save you a lil time.

That sounds like the correct I-129F. Ensure their are questions about Marriage brokers and criminals records on it. That is the requirement of the new IMBRA law.

Most of us here used the older version of the form, without those questions included. After the IMBRA law became effective on March 6 2006, all he!! broke loose. That is the purpose of the Request for Evidence (RFE) that included those questions on a "rider" type document that addresses those questions.

You are fortunate, in that the new form is all inclusive, so look for the Marriage broker and criminal background Q's on the form. That is the correct one to file.
