K3 or CR1

We were going to go for the K3 visa mainly because with the CR1, I will most likely not be able to enter the US while the case is being processed. I will have to be able to enter the US occasionally for personal and work (meetings, conferences) purposes.

A lot of people here seem not too enthusiastic about the K3 visa because of the wait time for the AOS.

Just how long does an AOS take to process? How long does the EAD take to process?

I'm in Canada right now. Could some of you tell me how long it took to process their:

- I-130

- K3, months it took from filing of I-130 to notice of K3 interview

- CR1, months it took from filing of I-130 to notice of CR1 interview

Thank you for your input. Although I would prefer the K3 visa just for the flexibility it allows in still being able to enter/leave the US, I would not want to be financially dependent on someone else (even if it's my husband) just because the AOS/EAD processing takes a long time. I would go for CR1 if it doesn't take very long to wait for.

CR1

is much better bcz u save money too

and not much paper work after u enter the usa

i did my CR1 in about 4-5 months

Our time line for CR1 visa took only 5 months and 1 week or 156 days; from the filing the I-130 on the 03-12-2009 to Approval of NOA2 on the 05/13/2009, then Interview on the 08/18/2009 at Manila, Philippines. We had a daughter on the 11-12-2010 named AISHA JOY means HAPPY LIFE.a1_opt-1.jpga2_opt-1.jpga3_opt-1.jpg

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

It seems the visa process has sped up substantially since I filed. K-3 is an obsolete visa, is twice as expensive and can slow your case down substantially.

Sadly the Montreal embassy is ridiculously slow in scheduling interviews - averaging about 2-3 months after a complete case at NVC. So for us Canadians, I'd bank on 6-8 months.

Go for the Cr-1, it is the superior visa

As you've already been told, K3 is pretty much obsolete but you should also know that your ability to come and go as a visitor is the same, whether K3 or CR1.

AOS takes a minimum of three months, as does EAD.

As you've already been told, K3 is pretty much obsolete but you should also know that your ability to come and go as a visitor is the same, whether K3 or CR1.

Thanks for the update. I thought you can't visit if it's a CR1 because of what it said here Comparison of Marriage Based Immigration Choices "Applicant will most likely not be able to enter the US during this time. "

I have another question (I have lots of questions today, because I'm preparing a list of things to do. :)

In the I-130 instructions sheet from USCIS, under "documents ... to prove family relationship", it lists "Any other relevant documentation to establish that there is an ongoing marital union." For those who had been married less than 2 years at the time they submitted the I-130, what documents did you include? Should I submit, with the I-130 - all (or almost all) docs I intend to bring to the interview? We're not going to include photos right? I can just bring those during the interview?
