Hi fellow VJ members!

Need help regarding with my friend's case.

He came here in the USA from Scotland 11 years ago, on a 3 month travel (tourist) visa and has been here all this time, ILLEGAL. He gave a lawyer $5000 3 years ago and the lawyer has done nothing and he cannot locate him.

Any advice for this case is highly appreciated.

Not enough information to give advice. What is this 'friend's' intention? (To remain - is he married? )

I think you're on the wrong forum to ask how to make an illegal become legal. He will have to leave but as he's been out of status for so long, he'll receive a 10 year ban.

Makes me wonder, how does one stay illegal unnoticed for such a long period of time? :wacko:

2/24/09: NA02 APPROVAL... finally, after 9 MONTHS & 8 DAYS!!

5/5/09 : Interview Date APPROVED!!!!

5/8/09: visa received

From NA01 to interview: 12 LONG MONTHS!!

07/23/09: received SSN

08/17/09: Passed Driving test

08/22/09: Married on beautiful Mackinac Island, MI

AOS

08/31/09: Mailed AOS Package

10/20/09: Received AP

10/21/09 Received EAD card

12/7/09 AOS APPROVED!

12/14/09: Green Card arrived in mail. Happy Days!

It's taken 18 months from applying for K1 to receipt of Green Card! Thank God it's over until 12/7/11

Here we go again...

ROC

09/14/11: Mailed I-751 to Vermont

09/19/11: NA01

10/14/11: Biometrics

7/2/12: Approved. New Card Ordered

7/7/12: Green Card received

I think you're on the wrong forum to ask how to make an illegal become legal. He will have to leave but as he's been out of status for so long, he'll receive a 10 year ban.

Makes me wonder, how does one stay illegal unnoticed for such a long period of time? :wacko:

thats what we called LUCK. Anyhow thats why Im here in this forum to seek advice for this case. Any helpful responce? :whistle:

Not married but wants to stay, has filed taxes every year. Use to work for BMW here but they let him go cause he did not have a green card.

oh man i gotta ask this how is he paying taxes if he is not legal he cant have a ss number, so is he using someone else's?

No, he does have a SS number, got it when he worked for BMW.

then at some point in time he had to be legal and have permission to work, and if he is paying taxes each year and not working for the company that sponsored his work permit to begin with there has to be more to this than what has been said

No Sara, he came here 11 yrs ago on a 90 days travel visa then you could work without a green card. Then 3 years ago the BMW dealer got bought by a new company and they let him go cause he was illegal. So he got a job as a mechanic at a garage that does now follow the laws. The IRS accept taxes cause the employer take them out of his pay.

then i would think he really needs a good attorney because he sounds like he is gonna get caught in kind of a catch 22

he was legal to work when he first came here and now its all changed. could be there is a way to grandfather him into some sort of visa i dont know this is more than i know about immigration.

but im sure he needs a good attorney

Just to kind of cut to the chase - your friend has no basis to adjust status (get a PR/Green Card).

Am not sure what his original attorney told him or even did - but that certainly would/should have been some part of the conversation.

If immigration isn't looking for him then maybe now's a good time for him to go home and find a different visa to come here on legally and pray that he's not on the list already.

When does a ban take initial effect? Is it from the date you leave or the date you entered illegally? It seems to me there was a guy from france on here recently who's ban took effect from the day he entered illegally.
