I know we must get married, but what forms, if any, need to be filed in the first 90 days?

Does the entire AOS packet need to be sent?

AOS is $1010.00

After you marry (within 90 days upon entry) - file the complete AOS package, before the I-94 expires to protect the beneficiary's status.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Hi, yes , you have to send all the AOS packet including the payment, please refer to the AOS guide here in VJ!, you have to apply soon for SSN and State ID too, don`t wait to apply when your visa is about to expire.

Yes, within those 90 days you MUST get married, and it's advisable you apply for your SSN. After you get married file for AOS as soon as possible although there's no time requirement for it (earliest possible as she will be out of status).

The only thing you MUST do is get married within 90 days. You can file for AOS after that and the overstay of the 90 days will be forgiven. It is advisable you get everything submitted ASAP as some members here have had problems with law enforcement after the 90 days without filing.

You must get married within the 90 days. You should apply for a SSN between 10 days after arrival but no later than 2 weeks before the I-94 expires - better to do it earlier rather than later. Ideally, you should file for AOS before the I-94 expires as that way your spouse will have no out-of-status days. Once the I-94 expires and your spouse hasn't applied to adjust status they are out-of -status and deportable. The K-1 is permission to enter the country to get married. The AOS is permission to remain in the country to live. Although there is no time limit for applying, you want to get that taken care of as soon as is possible as your spouse is at risk the whole time she is out of status.

I would like to see...one day...the AOS fee required as a deposit when filing for a K-1, or at the interview, minimum. I think it is ludicrous that people enter into this process, PROVE they can support their fiancee and then ..."Oops, I don't have that money I agreed to pay". The deposit could be returned if the marriage does not occur and the beneficiary leaves the country. Sheesh. I have no compassion for someone that enters this process, brings a foreign fiancee here and then does not make it life's priority to care about her needs. OK, off my soapbox.

You MUST get married within 90 days. It is BEST for all concerned, most particularly your new WIFE, the most important person in the world, that you file for AOS before the 90 days expires. It is not a MUST. But it is definitely a "I should borrow the money if needed" or take a part time job for if needed type priority. (OK maybe one foot is still on the soapbox, bad foot)
