Don't have a joint sponsor! Help!

Hey, I'm from Thailand and I've recently just got married to a US citizen. He doesn't make enough to meet the required minimum income. We've been asking the people that we know to help us but no one would be our joint sponsor.

Is there any other way to do this, like file for an appeal or something? Would an attorney help? Please help! We're desperate and my visa (B-2) is expiring in less than 2 months. Should I file to extend my stay with the USCIS? 'Cuz we will need more time to keep looking for a joint sponsor. I don't know anyone here and he doesn't have any close friends... We just want to be together :(

Thanks!

You guys applied for a tourist visa so how did it work? Can you give me some details please ??:(

Thanks

Your husband will need to secure another job giving him more income to qualify for sponsorship. Though not the most advisable course, you can put off filing AOS until you are ready...you will not be able to work, or travel outside the US, but your 'overstay' as long as you entered legally (which if you came on a B-2, you're OK) is forgiven once AOS is approved.

There is no way to appeal...and the I-864 is the affidavit of support guaranteeing to the US government that you the 'immigrant' will not become a public charge. If you do, the I-864 gives the government the right to sue the person who signed the form to recoup their monetary loss.

Unless your hubby can get a cosponsor the options are for you to stay illegally until hubby pulls in more bucks. You can go home a start the spouse visa process when he makes enough to qualify financially. If there isn't much chance of him coming thru with the money requirements then!

You guys didn't plan well.

hello there!!!

well i have had the dilemma before, you NEED to get a joint sponsor, it is not easy as it requires very intimate financial details of someone's life..but try and explain your position to his family members, employer or friends... the minimum salary bas is $21,800..im someone can help. be careful if that person has dependents, foollw the poverty line guide.

once, you get a co-sponsor, you can finish the filing...but there is a number you can call for immigration questions 1888 988 8678. they can tell you if you need to get a ne xtension whilst you wait for a cos-sponsor!

good luck

I know we didn't plan it well but that's because we didn't plan to get married! And the possible joint sponsors that we know..they don't want to do it. That's our main problem. We have all the paperwork and documents required ready. We just need a joint sponsor! It's so stressful!!

We would consider me going back to my country but it's not going to do anything better because he still won't be able to make that money to meet the requirement and we don't know a lot of people that would be our joint sponsor :(

We do not want to be apart :( but we'll keep looking!!

Thank you so much for your advice.

If you have anything at all that you want to let us know, please please do!

Why is it that your husband will never make enough money to do it himself?

Looks like the best bet for you would be to go back and stay in touch until he is able to support his new wife.

The best bet for him is for you to stay here, illegally, risking a possible 3-10 year ban, all the while he can not support his new wife.

My father worked two jobs. Why can't he?

Phil (Lockport, near Chicago) and Alla (Lobnya, near Moscow)

As of Dec 7, 2009, now Zero miles apart (literally)!

Updated!

I called the immigration and he told me that it's very smart to apply now before my visa expires and they will send us a RFE to ask for a joint sponsor and will give us time to find one. We're still looking for a joint sponsor but we're going to go ahead and mail all the forms to them.

Hi, I plan to stay here in the US because we can't afford to fly back and forth.

If my husband gets another job, he can combine the 2 incomes and if it's over $1,520 a month then it is most likely that we won't need a joint sponsor, is that correct?

As soon as he gets a 2nd job, we can put that in the I-864 right? And get his employment verification from his new employer? There is no time required that he has to have been working at that job for a period of time right? Because he is looking for a 2nd job right now.

Thank you so much!
