Let me explain. A few weeks ago, my stepson receive a NOA for his biometrics appointment which I thought it was a done deal, we were looking forward to this appointment, but just last week, he received another NOA stating the cancellation of the biometrics appointment. Has anyone had such stupid action taken by USCIS?

I don't know what our next step is. Do we wait until we get a new NOA for a new appointment? Is it this done because his visa is actually a K-2 visa and no biometrics are required? Should I call USCIS to find out what's next? If so, what phone number should I call? Note that we are in California. I'd really appreciate any feedback, and thanks.

As a general concept, biometrics are now a part of all visas(http://travel.state.gov/visa/immigrants/info/info_1336.html). However, it is my understanding that the special appointment is reserved for individuals pursuing immigration benefits/relief in the USA (unless the particular consulate requires differently). EG. your SO had a biometrics appointment once she got here in the AOS/EAD process, but during the K-1 phase her fingerprints were probably just taken at the interview, right?

It should work the same way for the K-2 (your stepson is not in the US right? You are actually in the visa phase, right?).

Nevertheless, I would call and confirm. There is nothing too stupid for USCIS (or anyone for that matter).

I have seen a lot of these types of posts. Same scenario.

I would call, and confirm. I would also still show up on the day the original document said to do. You never know.

USCIS would be the one to call, you might even contact the local office the appointment was set to be at.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Yes, my stepson is now living with us in the US. So what phone number should I call? I guess the best thing for now is to confirm that we may need to wait for another appointment.

I know of several cases (ours included) where an underage child got a biometrics appointment even though not needed. When we got to the appointment they decided he didn't need biometrics. I suppose they could just as well have noticed this before and sent a cancellation, but we were there for my wife anyway. To top it off they had scheduled the biometrics on consecutive days. We took our son there with my wife and asked for his to be done at the same time. Finally getting approval of that, I asked why he was having them at all, he was 13 at the time. The brilliant woman told me it was because he would have to come back when he was 14, so why not do it now. I expressed my doubt that 2 year olds are required to come back in 12 years as there was specifically no biometrics fee in his AOS payment, and she checked with a Supervisor. No, he did not need biometrics, but as usual the untrained clerk made up new rules rather than ask questions.

I just received biometric appointments for a 2 year old and a 10 year old. Double checked the I-485 & the I-131 instructions and both clearly state that biometrics are not required for children less than 14. :unsure:

Actually is not my son, but wife's son, which make him my stepson if I am right. Well is already 20 years old, and thanks for pointing that out about a minor not needing biomertircs. Thanks again.

I called the USCIS today, and it was just a waste of time. We need either to wait or perhaps take our chances and try a walk-in tomorrow to see if the office wants to perform the so-called biometrics.

yes, but the minor children must still get a photo taken... so while it is not the full blown "biometrics", they still need to appear.

My stepson did a walk-in for his biometrics, and he is done with this. We never got a rescheduled appointment NOA, which some people has gotten already. I am glad we took the initiative to go and do it. My wife told me that there was nobody at the place when they arrived early this morning.

Surely USCIS wants to take a week off after this Saturday July 4th.
