Back in the USA, Now What???

Hey everyone,

So I am back with the other half In Philly, everything is going great, although his hours just got cut to part time, which sucks because well i cant work and there are bills to be paid etc etc, We are planning to be Married July 17th (his birthday :)) But I am going out of my mind trying to come up with the money for A) The marrige papers and stuff for that and B ) the AOS.

I just wanted to know, Is there any sort of temporary work visa i can get? And when do we apply for the AOS?

Any help would be greatly appreciated!!!

You should file AOS (and EAD) as soon after you're married as possible (ideally before the I-94 expires).

Filing for EAD before filing AOS will cost you valuable dollars you would otherwise not have to spend (since the $1010 fee for AOS includes EAD if file with/after AOS). Plus it will only be valid for the duration of your I-94 (so it's kind of useless).

You may qualify for a Fee Waiver from USCIS - never know, might be worth trying for.

The most important thing you have to do right now is get married before your I-94 expires. Then once you're ready, file for AOS which can include your work permit (Form I-765). It may take about 3-6 months for it to be approved though.
