My husband wants us to file for joint bankruptcy,do you think this will not affect my on going AOS specially on our interview?Do i have the rights to dis agree with my husband?even if he is really gets mad when i dis agree with his plan? :crying: I'm really sad and feels alone now! :( Please give me some advice! :help:

He is legally responsible for you and showing he has the money to do so. I don't why your husband has such financial problems but he didn't plan very far ahead. I assume something unexpected happened. In any case, he shouldn't get mad if it's largely his fault.

Bankruptcy shouldn't be a first choice and should be done if there's no other way out. Both of you should do some research and get some professional advice. Money problems are a leading cause of divorce and you haven't been married long so tell your husband to calm down think carefully about what you're doing as a couple.

Bankruptcy shouldn't be a first choice and should be done if there's no other way out. Both of you should do some research and get some professional advice. Money problems are a leading cause of divorce and you haven't been married long so tell your husband to calm down think carefully about what you're doing as a couple.

Not to mention that you guys are going to be screwed for a long time regarding credit...this is the worst idea ever...you guys should talk to your banker and see if there is a way around!

Bankruptcy will not affect AOS

You do not have file joint bankruptcy and cannot be forced to. In fact, many times it is better NOT to file jointly.

Bankruptcy is an "easy-way-out" to get away from your creditors. I guess, its worth it especially if you have over $50,000.00 debt. But, your credit standing (credit score) will be greatly affected. Check your state bankruptcy law. It will help you the pros and cons before filing for bankruptcy.

July 23, 2009 - Biometrics day

November 2, 2009 - Approved

November 5, 2009 - Received via Mail "Approval Notice"

Just a small note. Bankruptcy laws are federal, not state. They are the same everywhere. The decision to file joint or separate should be counseled by a bankruptcy attorney. Your husband cannot FORCE you to file joint bankruptcy, neither can an attorney. But an attoreny can advise you as to what is best in your case. You should go with your husband to meet with an attorney.

Bankruptcy also has nothing to do with whether the husband can file an I-864 or "support" his wife. If his income exceeds the guidelines he will qualify. If his debt exceeds his income he can file bankruptcy. The USCIS doesn't care about debt, only income. The I-864 only protects the government, it has nothing to do with if a person can actually support you.

It remains on your credit report for 10 years. You can get secured credit cards, but other than that, nothing really.

Most anyone can get a car loan with a little down, but the interest rate, because of the bankruptcy will be very high. All other credit, if you can get it, will also carry a very high interest rate (because you will be considered a huge risk... untrustworthy). Bankruptcy, well done, charcoal broiled, you are seriously baked after bankruptcy.

One reward for a good credit score is low interest.

I'm not sure why joint bankruptcy is necessary.

Because if he alone files, the creditors will come after her for the debt - they are married therefor his debt is also hers :(

Not necessarily so. For example he can file himself on a jointly owned home, reaffirm the mortgage and continue paying but file on individual credit cards, medical debt, etc and they will NOT come after her.

Actually one person can file, relieve the family of a lot of debt, not hurt her credit at all, and keep things such as the house, cars, etc. Again, thi sneeds to be researched by a bankruptcy attorney and determine what is the best route. Mnay times it is very advantageous for only one person to file bankruptcy and keep the other persons credit intact.
