Hello everyone:

I would like to start getting my papers together to send out for my bf. We decided to go with the finance visa... rather then getting married since I hear I-129F is a bit faster.

I been reading the guidelines and I just wanted to doublecheck with you guys.. I send out

I-129F and coverletter, pictures, copies of birthcertificate, my naturalization, divorce degree. Is that all ?

At what point do I send out G329A ? Any other forms I need to send to with the first package?

Ok, Thanks guys.

well, read the guides a few more times. Karin & Otts suggestion is excellent. Look at the sample cover letter and contents. Unless something really doesn't apply to you, you will need all of that. Also as you read the guides, read through to the "end" the AOS. This is not three separate processes, it is one process with three distinct phases and you need to prepare for each as you move through one phase into another. As you file the petition, for example, you need to look ahead at the items needed for the interview, as you prepare for the interview you need to be looking ahead at the AOS.

Do not wait for the end of one phase to beging preparing for the next, or even studying what you need for the next phase.

So many times we see people post here "Well, my fiancee arrived and we got married but what is this about another affidavit of support?" Or "I had no idea the AOS cost $1010 and we just spent all our money on wedding flowers!" So read through it, all the way through it, find the snags, find the things that will be difficult (do you need a police certiicate from Singapore because you worked there for 8 months? etc.) and begin working on them now. Things like that come up on these forums everyday.

What Gary says is correct. Look ahead for documents that might take a long time to get. Prepare ahead of time and you will avoid unnecessary delays.

I've got a related question and was not sure where to ask it. If you don't mind my hijacking this thread for a second.

We are trying to be as proactive as possible with this process. So, I have started gathering interview docs already. Already being that we just got NOA1 last week. Now my question is this. Will this information (ie. I-134 evidence) be considered stale by the time it is needed? I've got letters from my bank and employer for instance. I guess what I'm trying to ask, but not so elequenlty is "Am I going about these things too soon?"

24 May 09 - We were engaged.

04 Jun 09 - Mailed I-129F to CSC.

15 Jun 09 - NOA 1. Letter in mailbox.

22 Sept 09 - NOA 2. Letter in mailbox.

21 Oct 09 - Interview, approved.

26 Oct 09 - Visa picked up at FedEx.

1 Nov 09 - US entry.

7 Nov 09 - Wedding day.

3 Dec 09 - Mailed AOS package.

9 Dec 09 - NOA 1 for AOS, EAD, AP.

It concerns me that you say you chose the fiancee visa because it is "faster" This is absolutely the worst reason to choose this visa. I hope you have thought this ot.

Your fiance is from a VWP country. When he arrives he will not be able to leave the country until you complete AOS or receive an AP, you are aware of that correct? You know he will not be able to work for several months after arrival? You know you will have to pay another $1010 after he arrives...correct? You know you need to submit TWO affidavits of support, yes?

Your inital question leads me to believe you did not read through the entire process. If your fiance has no intent to work or travel for 3-6 months after arriving, then the K-1 may indeed be best for you. But not BECAUSE it is faster. This is a long term commitment, make long term decisions.

For example, if he has a job in Germany, with a K-1 he will have to quit that job, come to the USA and sit in front of the TV for 3-6 months.

On the other hand, get married and file for CR-1 and he can continue working in Germany and then work immediately when he arrives in the USA. Takes longer than the K-1 but with the K-1 you are only half done when he arrives.

Depends when you have the interview. Kiev is fairly flexible about this. I had all the interview documents ready before we filed the petition, it is very much to your advantage with the way Kiev handles appointments. But I waited for the last minute for the I-134, just to be ####### retentive about it I suppose.

My wife will go to a K-2 to follow interview for our son next week and I prepared the I-134 about 6 weeks ago. I think, for Kiev, within 90 days will be very acceptable.

Hijacking threads limits your answers. Post it separately and it will automatically show up in the Ukraine portal which means you will get lots of answers from people familiar with the Kiev consulate. You hurt yourself doing this.

I think the 90 days that Gary mentioned is the unofficial rule. Like he said, it depends on all consulates, but I wouldn't get those papers signed more than 90 days before the interview. If you are saying that you just got your NOA1, then you are very likely more than 90 days away from your interview...then again, maybe not since Gary says the Kiev consulate is pretty fast...but who knows. If I were you, I wouldn't get these documents together just yet. I WOULD look into HOW to get the documents, but as far as printing them out and getting them officially signed by banks and employers and stuff....I'd wait until the NOA2 at least to do that.

Have everything prepared to print now, but don't get them signed until later. Just my 2 cents.

Good advice. I did the same. A little scouting ahead and found I could easily gety the employer and bank letters, I had the tax return and I just added the last remianing check stubs. I went to the interview and brought it with me. My I-134 was current within 7 days, but it isn't required. Yes, consultes vary on this. Kiev is fairly reasonable and I know people who's I-134s were 60+ days old and had no questions. BUT it is one of those things you can wait until the last minute for.

The instructions for the I-864 (there are no specific instructions for the I-134) state all documentation must be within ONE YEAR, but also says they can request more recent documents.
