I just found out last night that my fiancee's visa will be denied because she used to work at a go go bar, I have been informed that if I withdraw the current petition, I can file a new one that will reflect on the situation better. We don't need judgement, just advice. We are both good people, she did what she had to in order to feed her baby after the father beat her nearly to death and left them in the street. I don't know what to do now, there is so much at stake here.

Really? They will deny her a visa because of that. The things I read here on vj never cease to amaze me. I hate that for you guys. If that's the case Josh then I would withdraw your current petition and file a new one as you mentioned asap. It might be a good idea to hire a good immigration attorney as well if you still run into problems. Good luck buddy and I hope everything works out for you guys. Mike

Why do you think this? A bar is a regular working establishment and source of income.

My only concern is that if you are worried that it will prevent this visa, it will probably prevent all visas. For both the K1/K3 ones I know you have to answer questions about crimes of moral turpitude, and I believe, though someone can correct me if I'm wrong, it probably must be done for the CR/IR1's as well. They are questions you have to answer honestly and if thats why you think your K1 would be denied I am going to go out on a limb and say that the others will probably be denied for the same reason.

I would get a lawyer at this point to give you more sound legal advice, and best of luck.

I agree with most of the responses,,, about getting a lawyer to review... Keep in mind that working in a go go bar does not necessarily fall under moral turpitude (all kinds of girls in there).

If she has never been arrested, and has no NBI records... Ask a lawyer. They will best know how to proceed.

excuse me, but why would they deny her for that? And by what source could you possibly find this out? And withdrawing or not will make little difference on another petition and what do you mean "reflect the situation better"? To say truthfully your post makes no sense and I hope you will no tdo anything hasty.

before going ahead with cancellation, find out the facts first...who said that the visa's GOING to be denied (usually it is either approved or denied, unless you have direct access to the consul officer who actually decides on this); mere past work at a go-go bar doesn't sound like a good-enough reason for a consul to deny visa (i personally know a person who came here on a k1 and who was in the same job) unless there' something else to it; who told you to just file a new petition? (the old one will not just be thrown away, it will be in your record and will always be referenced)

you should check on every detail first to make sure that if you do file another petition it does not end up having the same results.

Very good advice from Gary and Alla. Think this thru carefully before making any decision that could impact the entire process not to mention your relationship. I still think consulting the best attorney you can find is your best bet.

They are not going to deny the petition cause she worked in a go go bar. Only if she is a criminal, or have a disease, or barking mad, a child molester, or something TRULY weird, she is not, she worked in a go go bar, BIG DEAL!!!!!, they will not deny her cause of her line of work. Dont do nothing stupid and cancel cause some smuck gave you bad information. I slung drinks in my college days, now do I need to worry about me being denied for working in a bar, NO.!!!!!!!!!!!! Dont be silly, it will be fine.

Some places GoGo bar = prostitution.

Rejected on moral turpitude grounds, if she was a prostitute, maybe, but working in a GoGo bar in itself is not grounds for rejection.

However, with that said - to the OP - who told you it was going to get rejected?

To me, this statement means you intend to make false statements on your petition, not a good thing to do.

(also leads me to believe that the embassy didn't tell you about the rejection, someone else did, because if they have your petition all ready, making a new one changes nothing).

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

So are you saying that she was a prostitute?
