I just had a friend who just wen through the visa process that I should send a copy of my fiances birth certificate to avoid an RFE, why would the USCIS not put this as an explicate directions if they require a copy of this document. I was going to send the I-129F today but now I'm not sure..... any advice?

If you have a copy, then include a copy, if not then don't bother.

The instructions say US Citizen's Birth Cert, this is for evidence of US Citizenship.

Foreign citizen's birth cert will be needed at the visa interview.

Is now a US Citizen immigration completed Jan 12, 2012.

I suppose you refer to the I-129F? The foreign beneficiaries birth certificate is not required for the petition. She will provide that at the interview. I did not include it with the petition and did not get an RFE. The only items you need from the foreign fiance(e) for the petition are...

1. G-325a

2. Fiance(e) letter of intent

3. Divorce certificate (translated) if applicable

4. Passport type photo

a couple years ago there appeared a few people were getting RFE's for the alien birth certificate... there did not appear to be a rhyme or a reason... I have not read any reports lately so it appears the rhyme or the reason has stopped

Right (as stated above) - there have been pretty rare occasions where the foreign fiancé's BC was asked for in an RFE - but it is rare and likely due to some other reason than you might think (i.e., specifically related to their case).

Most folks do not include it (since, as you noticed, it is not required specifically) and have ended up being successful. :thumbs:

I just waited a week for Janna to send me her G-325A's and intent to marry letter, plus her mother and father have her birth certificate and are on vacation for the next month and they live hella far from her. Thanks for the support, You guys are great!!!

i had my fiancee's birth certificate both her NSO and LCR copy, i even include her certificate of finality in our application coz hers had a correction.
