I know you feel terrible right now, but please remember that every single step in life is a test by God. You must remain patient, and remember this may be an obstacle but it can be fixed. I am not familiar with lawyers but the very informed VJ members here will help you with this and hopefully your husband will hear from the letter soon - and know what is needed for you to get this visa.

Just believe, and you will get it.

Remember that this journey is only beginning, and you and your husband will never be separated for too long.

I pray that you will receive help from God. Stay informed and contact any immigration laywers suggested here and also tell your husband to do some searches for lawyers that may be able to help you.

Application Type: I130 , IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN

Current Status: Denial Notice Sent

On May 28, 2009, we mailed you a denial decision notice for this case I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. The notice explains why the denial decision was made and the options that may be available to you. If you have not received this notice within 15 days from May 28, 2009, please call customer service at 1-800-375-5283 for further assistance.

Hi there,

I'm so sorry to hear about your situation.

My I-130 recently got denied as well on March 9th due to NOT receiving the RFE in the time alloted by USCIS. To make a long story short. The RFE was sent certified but was delivered to the wrong address.

This is a post office error and although we pleaded over and over with USCIS, they just turned a blind eye. They stated that once it's not their fault then there's nothing that they can do. The only option was before 30 days - I have a to file an appeal or a motion to reconsider which historically has taken longer itself, than simply to re-file. I had both congressional and senetorial inquiry done with no action(s) plus an infopass appointment which was a complete waste of time.

I understand in your situation that it's been an extreme number of years since you filed and so sorry that this happened. My first I-130 was sent last June 2008. I re-submitted another I-130 as per the advice of my attorney because filing a motion still does NOT gurantee anything and the cost is $585.00 US plus time and fustration.

Just a bit of advice, but it's up to you.

Take Care and Good Luck !!

I-130 re-submitted 05-22-2009

June 3rd 2009 - Rec Hardcopy NOA 1

June 5th 2009 - Touched

August 21 2009 - Touched

August 24 2009 - APPROVED - NOA 2

Sept 1st 2009 - NVC Rec - Case # assigned

wait until you get the formal letter and see what it it says in it, don't panic so fast, you may not even need a lawyer, maybe as easy as missing some thing or messed up at USCIS,(which always happens)

after all, even you get a lawyer, don't listen to the first one you see, as you may all know, lawyers talk too much and they don't talk for free, even for their BS you have to pay for it.
