Fiance's interview is tomorrow... today we had a conversation about the point of entry date... he's still working, to give notice and quit his job he should give at least 1 month notice and use another month to organize his life in Korea for relocation purposes.

Anyhow, he's planning on coming in late late july/ early august... but i was told that he has to come in to the States before his medical examination expires ? He had his medical on 4/23... which means his POE has to be before 7/23 ?

Is that true?

What's the guideline ~? anyone know?~

2/18/2009: Mailed I-129F Form

2/20/2009: NOA 1 Receipt Date

3/20/2009: NOA 2 Notice Approval Date

05/28/2009: Interview APPROVED

7/22/2009 --POE (LAX)-- We are together forever <3

You have 6 months to make your POE from the day the visa was issued. You then have 90 days after POE to get married.

10-28-08 Visa Received

11-01-08 POE

That was fast!

Got to love the fact my wife was preggy and even with a RFE @ NVC she was still here in under 5 months!

The medical is valid for a year after its completion date. After marriage on a K-1 visa, your partner needs to apply for Adjustment of Status from the non-immigrant fiancee to an immigrant. If the medical was done within the year of the date he applies for AOS he doesn't need a new medical. If the medical is older than a year when he applies for AOS he needs a new medical.

Your plans sound fine - once the K-1 visa is issued it has to be used within 6 months so that gives him time to give notice and make his preparations. Once he arrives you have to marry within 90 days. It is best to file for the AOS as soon after the marriage as you can. He shouldn't have any problems with his medical expiring on this schedule.

Well my fiance is telling me that Medical is only good for 90 DAYS!

Not valid for 1 year... is there a difference between the different countries and embassy?

I'm so confused~~~

What i meant was, during Point of Entry...doesn't he have to hand over his medical to the immigration officier ? that medical examination has to be current within 90 days ? I know K1 visa is valid for 6 months, he just doesnt want to go through the whole medical examination process again.

Any thoughts?

You have been told this answer... For US Immigration purposes a medical is valid for ONE year....

The most important thing is that the medical must be valid the day the visa is issued.... after that it is moot. It is possible to use the medical again for the greencard. If you apply for the greencard within one year of the medical exam then the visa medical can be relied upon. If not, then another medical will be needed to be performed here in the states.

The POE does not care about the date on the medical exam but the validity of the visa.

It should be o.k. 90 days period he was talking about is only for VISA interview at US Embassy, I think.

Medical Exam itself is valid for 1 year.

You should take Medical Exam within 90 days period from Immigration Visa Interview.

Then Consular Officer will put every documents including Medical Exam Result in mysterious brown envelope (MBE) with immigration visa stapled.

You have 6 months validity given for immigration visa to come to U.S.

Then you have 90 days to file AOS after POE.

So you don't have to worry about medical exam expiry for POE at all.

When he need to book airline ticket, he can request for special discount for immigration one-way ticket with his visa. :whistle:

Most airline have special discount for one-way ticket discout for immigration.

The packet he hands to the immigration at POE indeed includes the medical, but it doesn't ONLY include the medical so what counts is what's in the visa. 6 months.
