My lady and her son plan to return to Ukraine this summer to visit her family. The travel agent has asked how her ticket should read -- specifically, what last name her ticket should show. Here are the facts:

She came to America on a K-1. We were timely married. Her last name is now the same as mine.

Her Ukrainian passport is, of course, in her former name.

We timely filed for AOS, AP and EAD.

Her AP has been approved and she has her I-512L, Authorization for Parole of an Alien Into the United States.

Her I-485 is still pending and the green card has not yet been issued.

Can one of you great VJers who is married to a Ukrainian tell us how her airline tickets should be issued and how you have handled this situation in the past?

Also, have your Ukrainian ladies done anything while back in Ukraine to change their passports to their married name?

Use the name that is on her current passport.

You may be able to change her passport by contacting your local embassy for the Ukraine here in the states.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

The name to use on airline tickets is the one that matches the passport. Bring other proof showing married name (for reentry if asked). For security purposes - airlines will not allow a person to travel on a name not in their passport.

Use the passport name. Carry a copy of the marriage certificate and AP, also a copy of the I-797 from the AOS filing. Her passport should also still contain her K-1 so there is plenty of documentation.

Regarding changing Ukraine passports. My wife did not change her name so that is not an issue. I would strongly suggest you get her son his own passport if he does not have one already. She should take with her a copy of the letter allowing him to leave Ukraine for the USA that you had for the visa (if he is under 16 years old) She should also carry a copy of his birth certificate to verify she is his mother (she will need these things when leaving Ukraine until he is 16 years old, even after he has his green card) and a copy of the father's passport to verify he signed the letter, same as you had for the interview.

She is not going to change her residency in her passport as it will triple taxes on property we own in Ukraine. The bad thing about this is that she cannot use the Ukrainian consulate here for things such as passport renewal, etc., she will have to go back to Ukraine to do these things (she will go there a couple times a year, so it is no problem for us) Her sons will be listed in their passports as US residents.

My wife and son are in Ukraine now and she took all these documents with her. The name situation is not an issue, really, traveling with the child is much more of a concern and must be documented if the child is under 16. when my wife enters Ukraine, she does not present her green card, only her passport. Leaving Ukraine she presents her passport and documenation about our son. The only time the name will be an issue at all is re-entering the US, which she is doing with US issued documents (AP) so save her trouble and use the maiden name for the plane ticket.

There is no need to ever change her name in her passport, at least not until she becomes a citizen.

Some countries (Colombia for instance) add a notation in the passport that the subject is now married - the passport remains the same but it now carries your proof of marriage (and the married name), so you just carry your greencard and the passport for travel. The process is called 'Registration of Marriage' and the consulates normally do this for free or a small fee - perhaps checking with the Ukraine embassy might tell you if they do something like this or not. Any idea as to which surname the green card will come with??

The U.S. marriage license signed with married surname.

Filed all documents with USCIS and NVC with the married name (included maiden name when asked for previous names used)

BUT my wife's Italian passport has her maiden name (Italian law will not allow for the surname to be changed).

The NVC uses her maiden name because her passport has the maiden name and the visa must match the passport.

Will the green card come with her married or maiden name?
