Hi

I am working in the UK and has got work permit in UK. My wife is a us-resident (green card holder not citizen yet, will be in 2011) living with me in the UK.

I was wondering if I apply i-130 now, can I file the application for immigrant visa application from UK?

Also what will be the estimated processing time to get a immigrant visa number?

If there is any other faster and better option please feel free to suggest.

LPR filing at the UK embassy - I don't know if you can do that, since not really a "citizen". Good question though - I will see if I can dig something up.

However, is your wife maintaining her LPR status in the states? (not leaving for long periods of time) - they count that against you (when you go up for citizenship).

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

As far as I know, you (well, your wife) will have to petition in the USA (you can find a friend or family member who will be your mailing address in the US), DCF is only available for USC, because US residents are supposed to reside in the USA, hence the name. I don't mean to be flippant by saying that, but as the previous reply said, your wife may not be able to file for her citizenship when you anticipate- in fact, may even put her green card in jeopardy- by living with you in the UK.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
