Hi, I have a question about applying for a K-1 visa:

Do I need letters of consent from my fiance's as well as my parents? I am 20 and my fiance is 21. Also, my parents are divorced, and I've since lost contact with my father. If I need a letter of consent, will his signature be required?

Also, is a part-time job alright as long as I have a co-sponsor? I am studying legal transcribing right now and only have a part time job.. I don't know if this is acceptable or not.

No, you do not need letters of consent from your fiance's or your parents. You are both above 18, and age-wise free and legal to marry in the USA.

For the visa no.

Your country may or may not require parental consent.

No, you do not need letters of consent from your fiance's or your parents. You are both above 18, and age-wise free and legal to marry in the USA.

Actually that's not correct. It is Country Specific.

Some countries like Philippines requires a Parental Consent if you are between 18 and 21.

If you don't have it they will not let the Beneficiary leave the country......

As far as the income question the USC must earn 125% of the 2009 Poverty Guidelines for their household size. Assuming it would be just you and your fiance(e) that amount is $18,212. ( http://www.uscis.gov/files/form/I-864P.pdf ) If you do not meet that income level you most likely can have a co-sponsor. There are a few embassies that do not allow a co-sponsor at the K visa stage. Do some reading here on VJ to learn about co-sponsors.

No, if you are free to marry according to your country's regulations.

Yes as long as combined you have enough income to be above the required minimum amount.

I hope this helps you. My fiance is 20, just turned 20 actually, I am significantly older, but I had the very same question and sent a letter to the embassy where my fiance is from. I was worried about this because where my fiance is from the "legal age of consent" to marry is 21, however many do get married younger with consent. The embassy responded to me that because she would be coming here, and the state that I am in, the legal age of consent is 18, so therefore the countries laws that your fiance is from do not apply. I would if I were you, see if you can find the legal age of consent from the country she or he is in and then also check the states laws that you are in. If you or your fiance is below the legal age of consent, then I would try to get those letters to be safe. You don't want to be stuck with an RFE, like me. It s**** after waiting 4 months with no touch's to get an RFE.

No. Age 18 is the magic number in all states.

If you have a qualified co-sponsor your job situation is not so important, but you still need to complete an I-134.
