So, what's this about AP and NVC? If someone is appyling for AOS do you get AP as well? Or, is the AP just for "in the meantime" until the temporary GC comes? Oyyy... could the immigration be any more confusing? Wait... I know the asnwer to that - let's pretend I didn't say that. :pop:

:lol: So when you apply for AOS, apply for EAD/AP at the same time (cost is inclusive $1010). AP is just to have until your 2 year GC arrives, AP and EAD are valid for 1 year. You should have your 2 year GC after 1 year and therefore the EAD/AP are void. Your fiancee can use the AP as many times as he likes until the GC comes.

I'm almost certain that the AP and the EAD are just temp until you receive your GC. The GC itself gives you the right to travel outside the country and work... the other documents just allow you to do those things before your legal permanent residency is established. I've been reading :yes:

But AP and NVC... I think that's what they call getting stuck at the NVC stage of the k-1 process for additional security checks and stuff. Glad that never happened to me!

Now, what if he doesn't want AP? Thing is... he wants his family to have to come here for Christmas. Otherwise, he doesn't think they'll EVER come over here and expect us to go there ALL of the time. Which he thinks is dumb and stupid. I do too, but I try to keep that to myself... it's always nice to have goals and try new things... *he he he*!

Okay, so the NVC AP is a different AP... that's right! I do remember that! I kept seeing AP in this thread or that thread... took me forever to keep the two APs straight. One AP in one process is different from the other AP in another process. Thanks for the reminder of the AP in the K1 process... that was so long ago! *duh* :wacko:

BTW, I did know that the EAD was a part of the AoS $1010... that's ONE of the things I do get!!! LOL

:lol: Its all good! We're learning together! The $1010 fee is for the AOS, the EAD AND the AP. So you might as well apply, since its free... But I suppose you don't have to if he doesn't want it! I'd apply just so you have it in the event of an emergency and just tell him not to tell his family he got it :P (sneaky I know...)

By AP you guys are taking about Advance Parole correct? What does the NVC thing have to do with it? NVC doesn't have anything to do with it ....I think! Now I am confused!! :P

If this is what you guys are referring to, then yes, it is included in the I-485 fee of $1010. Apparently, you can file for it NOW or at a later date: From USCIS:

2007, and you paid the I-485 application fee required, then no

fee is required to file a request for Advance Parole or for a

Refugee Travel Document on Form I-131. You may file the

concurrently with your I-485, or you may submit the I-131 for

Advance Parole or a Refugee Travel Document at a later date.

If you file Form I-131 for advance parole or a refugee travel

document separately, you must also submit a copy of your

Form I-797C, Notice of Action, receipt as evidence that you

filed and paid the fee for the Form I-485 required on or after

July 30, 2007.

AP is something you have to APPLY for (Form 1-131) and yes, it is temporary (but valid for multiple uses for a year) until you get your green card. Once you have it you can leave whenever you like - or rather come BACK whenever you like :P

I would advise anyone to get it JUST to have it. From what I understand, they are very strict with the "emergency ones" (the ones that you can get in like 3 days or whatever) and often only grant it for death (AFTER the receive the death certificate :blink: ) And I know for me, even if someone was SICK I'd be wanting to make it back! It's piece of mind in my eyes. And although they make it clear on the papers that it has to be a specific emergency TYPE of case, when i was talking to the CPB agent who filed me through at POE, he was saying people now are abusing it (but he was grumpy and just didnt wanna file the paperwork for it haha) and was telling me that this one guy would go to the casino in Canada and his GF would go get her hair did. So, they grant it for anything now I guess. But, I wouldn't put on the form that you are going to get your hair done ;) who knows what they put but I dont think they can deny you for wanting to go home. I am just putting to visit my elder parents (they are elder but not like 89 elder :P )

July, even if Duncan doesn't want/need AP, apply for it with the AOS package. The application I believe is 1 page, simple. You're paying for it, so apply. He may not plan on using it, but what if his GC takes a long time to arrive, like a year? He won't want to go home the whole year? Also, what if there was a family emergency? Imagine not being able to go home in case of an unfortunate event. Emergency AP can take days and why have to do that if you can get it for piece of mind. That's just my 2 cents LOL

The AP they are mainly talking about IS the Advanced Parole (good to have). The other AP they are referring to along with NVC is Administrative Processing (BAD to fall into).The 2nd one means your case could be held up for god only knows how long.

Aww thanks poprocks!!! Yah this was in our actual WEDDING in Honduras. On Friday, I just wore a nice outfit sans wedding dress. I joked to my fiance that we should show up in our wedding attire to the courthouse hahaha can u imagine?? Too funny :)

Nope, that's just fine! I put a few dates in there, like "2 weeks in March to visit family" but you don't have to be specific.
