The clock only stops when you get the NOA for the AOS.

So, will you have the AOS in before your I-94 expires? (not sure how long your medical will take)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

We sent in my husbands I-130/I-485/I-765 February 27 2009. I wasn't clear on whether or not to send the Medical exam with it so we sent it without.

We received an RFE last Thursday for the Medical. We had a Civil Surgeon who was walk in only, NO APPOINTMENTS so we went the very next day (Last Friday)

We were the only people there, they took my husband back, drew blood for HIV & syphalis test, gave him a tetnus, mumps, measels and rhubella shot and a TB test and told us to come back on Tuesday (after we paid $280).

We went back on Tuesday they looked at his TB test, said it looked good, my husband signed the I-693 in front of them, they gave us the sealed envelope for USCIS and gave us a copy for our records.

Both appointments took less than 30 minutes TOTAL!

So ours is in the mail on its way back and we are ANXIOUSLY awaiting its arrival so they can process our papers.

05/15/2009 NOA received with I-485 interview date 07/20/2009

Ok - so you have your NOA? If so, your covered status wise.

Yes you can and you will get the RFE BUT AT LEAST ITS THERE!!!!!!! I had one other document I needed but didn't come in time for us to send it with the packet so I sent it in when it arrived with his Alien Registration number and Receipt numbers on it and sent it in after the fact BEFORE they got around to an RFE.

It's not that big a deal to get your AOS in before the I-94 expires. Yes, technically, you are out of status when the I-94 expires, but once your AOS is approved (whenever you send it in), that is "forgiven". People have waited a year or two and got approved without a problem.

Immigration won't come looking for you once the I-94 expires, but if you were to commit a crime or even get stopped by the police for speeding or something, you could have problems. So it's better to send in by the expiration, but not 100% mandatory.

Don't worry about it so much.

If you had the medical in Spain you shouldn't need a full medical, just the vaccine supplement. Search the forum for Dr. Arnold, he'll do it within a few days for $30.

Ditto to the above, overstay is forgiven with AOS, so if you file a little late, it shouldn't be a problem.
