hello vj... i dont know what to do... i applied my ssn after i got married, which should be before the wedding and now, my I-94 is about to expired on May 4th, i dont know what to do, i cant file my AOS without it, will they send me back to Philippines if i will not file AOS after the 90 days period? thank you for your help in advance...

Where does it indicate you cannot file you AOS without a SSN?

I can assure you it does not say that an SSN is required to file the I-485... in the form box where it asks for SSN, you would simply indicate NONE

Calm down firstly :).

Why do you think you need an ssn for AOS? you don't. It also isn't a problem that your I-94 is expired, apply for AOS you are fine there is NO time limit to file your AOS, bills & living come first sooner is always better but don't leave yourselves broke.

Some people need an SSN to get married (depending on the state) but since it is near to impossible to get an ssn after marriage (with an expired I-94) it would be ridiculous if USCIS required one.

Don't worry, you are fine without one! :) .

No you can file your AOS even without your SSN.

I would disagree with that statement. The time limit is the I-94. When it expires, you are out of status, even if "married". Not a good place to be, it can cause problems with ICE.

Also, being out of status can count against your AP (more than 180+ days out of status can result in a ban on re-entry) if you use it.

There are cases where this has come into play on this forum (one case in Texas where the married couple, even with the marriage license and passports, could not show the NOA for the AOS)

Will being out of status affect the AOS? No, as long as you entered legally - but why risk problems while waiting?

So I would urge everyone to AOS ASAP. That should be priority, and people should be saving for that as soon as they apply for the various visa's so there is no "out of status" time.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

just put "none" on the form. file it ASAP to avoid problems with your application. maybe that is the reason why it takes to long for the USCIS approval because of late filing. Good luck..

I only said there is no time limit for AOS, because there isn't, the impact that has on other forms (AP) etc; is way out of my knowledge base. I have seen people be out of status for a day and they are panicking because someone told them that USCIS will deny there AOS and they will be kicked out of the country.

It can take a long time to get your SSN too, I applied for mine in Jan and only this week did I receive it. But you dont need your SSN for the AOS like everyone else said.

Sorry to piggy back on someone elses question....

But when do you all suggest is the best time to apply for SSN?

Do you wait 2 weeks so the POE has entered you into the system?

I plan on applying right when I get there....marry a few weeks later....and change my name when I go back to get the restrictions removed.

I printed all the stuff off the VJ guides.

What's the soonest people have rec'd one? And how long can it potentially take?

Thanks, I just figured since SSN experiences were being exchanged on here...I would ask!
