i-485 interview after i-130 interview ????

Thats strange. Alone overstay cannot lead you to removal proceedings. Now yes it can do if you have overstayed that long. You urself said that you married 2 months before being placed into r.proceedings. I wd request you to tell us how long did you overstay and from what visa. And pls fill out your timeline to get a better understandings.

That makes a lot more sense about a second interview and why they maybe questioning things.

Filed for AOS . Sent through USPS Priority Express : March 03, 2009
Package Delieverd at USCIS: March 05, 2009
March 13, 2009 : Checks Cashed
March 13, 2009 : NOA 1 received on I-485, I-130, I-765. Dated March 11th, 09
March 17, 2009 : Biometrics Letter recieved (Dated 13th March). Interview on 1st week of April
April 2, 2009 : Biometrics done. Total time taken with wait 20 mins.
April 22, 2009 : Called USCIS. They have received fingerprints and work permit is in process.
May 7, 2009 : I-765 case online. Card Production ordered.
May 11,2009 : EAD card received.
May 12,2009 : Applied for SSN.
May 18,2009 : Received SS card.
June 08,2009 : Received Letter for Interview ( scheduled on July 14 th July )

Weird, As my husband was here since 2001. He owned his own buisness and everything. We got married in April of 07 and applied in May of 07 and were approved in Sept of 07. I find it weird that you were in removal proceedings for an over stay, but hey you passed the first test and now on to the second. I wish you good luck on the I-485 Interview, just bring the same proof you did for the first interview.

Why is it that the only one who can stop the crying is the one who started it in the first place?

I wish you good luck on the I-485 Interview, just bring the same proof you did for the first interview.

It may not be for an overstay - normally they will that slide, unless there are other disqualifying factors. Won't know till you get the letter from them.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

According to the USCIS, "you are not eligible for adjustment of status if any of the following apply to you:

A. You entered the United States in transit without a visa;

B. You entered the United States as a nonimmigrant crewman;

C. You were not admitted or paroled following inspection by an immigration officer;

D. Your authorized stay expired before you filed this application;

E. You were employed in the United States, without USCIS authorization, prior to filing this application;

F. You failed to maintain your nonimmigrant status, other than through no fault of your own or for technical reasons; unless you are applying becauseyou are:

1. An immediate relative of a United States citizen (parent, spouse, widow, widower or unmarried child under 21 years old);

2. A K-1 fiancé(e) or a K-2 fiancé(e) dependent who married the United States petitioner within 90 daysof admission; or

3. An H or I nonimmigrant or special immigrant (foreign medical graduates, international organization employees or their derivative family members);

G. You were admitted as a K-1 fiancé(e), but did not marrythe U.S. citizen who filed the petition for you, or you were admitted as the K-2 child of a fiancé(e) and yourparent did not marry the United States citizen who filed the petition;

H. You are or were a J-1 or J-2 exchange visitor and aresubject to the two-year foreign residence requirement andyou have not complied with or been granted a waiver of the requirement;

You have A, E or G nonimmigrant status or have an occupation that would allow you to have this status, unless you complete Form I-508 (I-508F for French nationals) to waive diplomatic rights, privileges and immunities and, if you are an A or G nonimmigrant,unless you submit a completed Form I-566;

J. You were admitted to Guam as a visitor under the Guamvisa waiver program;

K. You were admitted to the United States as a visitor under the Visa Waiver Program, unless you are applying because you are an immediate relative of a U.S. citizen (parent, spouse, widow, widower or unmarried childunder 21 years old); or

L. You are already a conditional permanent resident."

Ooook I got my answer a friend of a friends father is an io. and he told me " the reason I have 2 interviews is because the IJ sent my i130 for processing to determin if I could be relived from r. Proceedings on tho

E grounds So when the I 130 got to my local office. It came there asking for an interview to verify that it was entered in good faith, at that time my I 485 was still pending @ texas sc. And it could not be ajudicated while I was in removal, so being that I entered a motion for termination with my I 171 (aproval notice for my I 130) and the judge terminated witout me going back 2 court , when I made the info pass and took them the termination of r.proceedins notice they imidiatly requested my I 485 to be transfered to the local office so they could scedule an interview to determin if I am eligeable to adjust status and register perminant residence...... if approved I will recive a permanant G.C. because my marrage is over 2yrs old ...... I will let you all know what happens. .......... pray for me
