It sounds like you got your NOA1 - the first notice of action in October. Do you also check you online status? If not, go to the USCIS online status page and create an account using your receipt number (on the NOA1 and on the back of your cashed check). This way, you can check daily to see if the "last updated" date changes.

You are most likely stuck in security checks. I would think your lawyer would be able to find this out. Do contact your congressman and good luck.

Uhm i would deffinatly get ahold of your congressman/woman ASAP, 9 months is too long to wait for ANY service center. I know how you feel bout the not getting beyond the CSR when you call, its as far as i ever got as well, and none of them are helpful anyway. Your lawyer should have been contacting your state rep id say months ago, there is something wrong if youve waited this long.

The only other thing i can think of is you could be in AR, and AR can take this long, from what ive seen of other people going through AR. I would deffinatly try to find this out.

Good luck to ya

I filed my I129F over 9 months ago and have not recieved anything but the letter they send you when you do an inquiry . It shows outside processing time and says they are reviewing my case . I have an immigration attorney but he seems to be at a lost also. He supposedly contacted a Senator to help out but no word as yet. Since I cannot contact them directley except for the customer service reps that take down the information. I am starting to loose hope. I filed in Vermont back in September 2005 . All the paperwork was in order . My fiancee is from Albania and we are heartbroken . Does anyone know of this taking as long as my case and could give me a glimmer of hope with some information? Also can someone explain to me what an NOA1 exactly is and when you should normally recieve it. I assume it is the first letter of acceptance . :(

My fiance' is also from Albania. I don't think his citizenship is why this is taking so long for you and I don't think he is going through special security checks either just for the reason (though, of course, I could be mistaken).

If I were you, I'd go over that lawyer's head and call the USCIS myself and ask them directly what on earth is happening with your petition. Meantime, I think you should also contact your congressperson directly. I don't know if you're from NY state, BUT NY congressman Eliot L. Engel is a chairman of the Albanian Issues Caucus so maybe you can even try and contact his office.

AR is Administrative Review-some casees are pulled for more "in depth" security checks-this could be what happened to you but 9 months???????????????? I woud have called someone by now. You should call USCIS-or if you are paying a lawyer-have them do it. 9 months is ridiculous. Don't you have your case #?

and please FILL IN YOUR TIMELINE

I have been calling the VSC since January , before that my lawyer was calling . I plan to see my congressman this week. I have a case reciept number as I have been calling to do inquirys all along. I updated my timeline here ; but it does not list Tirane , Albania for the consular section . Also want to know what "touched" means . I assume it means the inquiry letters.

It means someone did something with your case i.e. picked up a file, moved it to someone else's desk, put it in a different pile, or actually worked on it.

I have always checked my status online but I just entered the EAC and got the same answer : " Your I129F PETITION FOR FIANCE(E) was recieved on . We will mail you a decision as soon as processing is complete blabblbla.etc. I now registered and see the last updated case Date and I was livid. It says November 7 , 2005 . Does anyone know of a number I can call at the VSC to get past the call center and talk to someone who can really expedite or at least explain what is going on .

A few suggestions for you:

1) Get your lawyer to do what you pay him for - he should be contacting them weekly and getting answers for you. There is no excuse for him to not be actively working on this for you.

2) Contact your congressman or senator NOW. Find their website online, download the privacy form, fill it out with your case information including dates and receipt number and fax it to their office. Call to follow up a day or two later. Stay on top of them to get you an answer regarding the delays and stay in touch with the immigration contact there weekly.

Hopefully someone will also post instructions for how to get through to a live person at Vermont.

Good luck.

Wow, 9 months! And how did your lawyer missed the update in November? Geez.

We've been using these numbers to talk to VSC:

1-800-375-5283

press 1 pause 2 pause 6 pause 1

Enter Receipt #

press 3 pause 2 pause 1

However, it's not very likely that they will be able to give you any info especifically on your case. You have to get really lucky to talk to someone who will actually check on your case for you over the phone.

I only offer advice - not even legal. Just the plain and simple kind.

Your probably stuck at security checks. We've applied for a k-3 in December and its been almost 7 months since our first NOA. Contact your congressman/woman yourself and your senator. Also, you can request status of your case which takes 4 weeks for them to reply, and sometimes they don't reply at all. But our congresswoman was very helpful because they replied to her.

So good luck,

I wish you the best.

You need to get rid of that lawyer.

1. How could you go 9 months with a lawyer and he not explain what a NOA1 was? If is unable or unwilling to answer your questions and if you find out he has lied to you about contacting your senator, you need to report him to the state bar association and find a lawyer who would be willing to file suit againest him pro bono to sue him for your fees and alot of pain and suffering. If doesnt have proof of doing what he says he has, you got him and he is looking at some major problems.

2. Follow the advice of others here on how to contact senators and representatives, also the info on how to contact Vermont service center.

I hope that you finally get your case sorted out and that you manage to take that lawyer for every thing you can. I am not a big fan of lawsuits but in this case you need to make sure he doesnt rip anyone else off.

First and major reason I have done this on my own, I am my own best lawyer, because I have my interests at heart. Scum bags like your lawyer have only one interest. YOUR MONEY>
