Hi guy's! I just wanna asks about the case of my friend,2 guys filed her K 1 Visa...I was trying to help her to lessen heartaches about her problem.So, i am here asking ur help in hr behalf..

This is the story of her problem...Last year he met the first guy then after few months of chatting..the guy come over here met and engaged her..After the guy back to his country he filed K1 visa for my friend and few weeks they got NOA1...after they got their NOA1 my friend wanted to back out for many reason and want to cancell the visa..She told her first fiance..So after few weeks she met new guy and they start talking online evryday after few months then the second guy come over here..met and engaged her..When new guy back to his country after few weeks he filed K1 visa for my friend...but no case number yet...Just last month ago the first guy sent her email telling that their visa is approved and have manila case number already....so she confusing now what to do...Is she have no chance anymore to grab the first guy visa now that the second guy filed her petition too and no NOA1 yet? Because accoring to her she said the second guy told her that she dont have chance anymore for first guy visa coz he filed already her visa and now its in USCIS now? I dont know what to advice my friend coz i dont know this kind of problem...Please help me in behalf of her..she really worried now..The first guy want her to come and go through for thier visa but my ftriend worried coz new guy telling her no chance anymore for the first guy visa..Is it really true that she dont have chance for the first guy visa? hope u help me..please any helps would be much appreciated..thank you,,,God bless you all....

Not good at all, i think they ll have to cancel one of the petitions as she cant have two different men fillling for her k1 at once. meanwhile be prepared for the big...huge...red flag! The Embassy wont turn a blind eye to this one...as they have both petitions already.

Important question, whats the time frame between the first filling and the last one?

Its amazing that she's also willing to switch asap since the visa had been approved. Does number 1guy know that shes been creeping while he's been sleeping or sending hard earned cash to uscis in the name of applications and running around to gather evidence?

She will just hope that USCIS will cancel the other 1.In my own opinion they will not cancel the 1st one coz it has already a case number and the other one is not approve yet unless the 1st guy will send a letter to USCIS or NVC to cancel his petition.

I think she lost her credibility to prove that she will come here for love not for a visa.

My husband had a fiancee before he met me but he found out that she was cheating so he cancelled it in USCIS, and they told him that he cant file for another K1 visa for 2 years.

But i hope that she can solve this problem ASAP....

This is the 4th time this same question is asked by two different member names, second time for you. Please stop. You have your answers.

I'll go ahead and answer for later searches even though I know *you* already have an answer from your other threads.

Only the USC/petitioner can cancel a petition. If guy #1 did not cancel the petition after she asked him too (which it sounds like he didn't since he is telling her that the case has been approved and sent to Manila), then she cannot apply for a second K-1 and expect it to get anywhere. USCIS will not issue another case number or approval for the same girl when she already has a K-1 pending. If the first K-1 is canceled THEN they can apply for a second K-1 and theoretically, there is nothing illegal about that (although, it will raise some huge red flags and I think your friend will be VERY hard pressed to provide evidence that this is a real relationship when we can see from your post that it is not!).

Also, guy #2 is wrong. She still has a chance to go to the Embassy interview when she gets it and get the K-1 visa from the first guy. BUT, this is very very unlikely. They will see that she filed ANOTHER K-1 petition in between the first K-1 petition and the interview so that right there will scream "This is not a real relationship and I'm just in it for the Green Card!!!!" and because of that there is a HUGE chance that the visa will be denied. After the visa is denied, the US/petitioner (#1) still has to cancel the petition. If he doesn't cancel (and he probably wont, just to screw her up even more!) then she has to wait for the petition to expire (and I'm not sure how long that will take...but it's a while!).

Once the FIRST petition has expired, guy #2 can petition for her AGAIN. In my opinion, I'm okay with this scenario in that USCIS is getting $455 off of these guys each time they file for this girl....maybe it'll make the rest of our visas go quicker since they're getting all this free money (although poor American guys if they think this girl is for real!). But again, with the petition from guy #2 (after the petition from guy #1 has expired), you aren't very likely to be approved unless you can show that it's a real relationship...and good luck with that.
