Hi I am very new to this and have a few questions on the best way to bring a girl here to the usa, we are wanting to marry, but here are the things to consider, She has went to school to be a nurse, she is in the process now of passing her boards there to practice in the Phil, she wants to continue and get her license to work here in the usa so it will require taking the NCLEX and she can do it there which I say is better.

Now she already has a visa that will allow her to stay in the usa for 6 months she has been here before , 2 years ago but I did not know her then,

Her dad was american but he died and this is the reason she came to the usa was to do paperwork about his death. (he lived in the Phil with her and her mom)

Which way would be best to marry and the best way of getting her Immigration here in the usa.

Here are the choices.

1. She comes over on her Visa and we marry, but it is good for 6 months?

2 We try and get her a work visa here in the usa and then marry why she is here?

3. We apply for a fiancee Visa I believe is k-1

4. We Marry in the Phil and then try to bring her here?

Now the next question is I am a Farmer, I do not make alot of money that shows on my tax forms cause of the way I work and my investment back into the farm. Do they go by gross or the end line on how what you make and will I run into problems. if it is not much?

I make enough to support myself and her with out problem I have my own home only thing would be insurance, but I am hoping that when she comes here she will be able to get a job that will get insurance for both of us.

I am paying her way through to take her test to get her license now also. to show support for her.

2 We try and get her a work visa here in the usa and then marry why she is here?

3. We apply for a fiancee Visa I believe is k-1, Yes you can do that under a K1

4. We Marry in the Phil and then try to bring her here? Yes, you can do that too. Also you can apply for a CR1m which will allows her to work faster when she comes here. Read the guides.

Now the next question is I am a Farmer, I do not make alot of money that shows on my tax forms cause of the way I work and my investment back into the farm. Do they go by gross or the end line on how what you make and will I run into problems. if it is not much?

2 We try and get her a work visa here in the usa and then marry why she is here? Visa fraud = using a non-immigrant visa, like a work visa, to get her here as an immigrant

3. We apply for a fiancee Visa I believe is k-1 BEST choice

4. We Marry in the Phil and then try to bring her here? You will leave the Phil and file the I-130.

Now the next question is I am a Farmer, I do not make alot of money that shows on my tax forms cause of the way I work and my investment back into the farm. Do they go by gross or the end line on how what you make and will I run into problems. if it is not much? They take your income after taxes, you will have to have 125% over the poverty line or get a co-sponsor

There are a few unanswered questions...did she overstay her visa the first time? How did her father come to the states? The only problem with her coming over on a visa and getting married is she can't go back for about 1 year with all the paperwork, the K-1 visa is the right way to do it, but it will cost you a about $2000.00 with the medicals and forms. As for working as a nurse here in the states, make sure they will accept any type of certification taken in the Phills. As for the income its taken from your adjusted gross income....if you have another family memner they can be a co-sponsor...and showing support takes more than you paying for her test...

Why doesn't she have her US citizenship?

Hi, No we have not met yet, we are trying to figure out the best ways to go about things first whether I should travel there, or for her to come here,

Her father was and American that was stationed in the Phil, he met her mom and they were married and then lived in the Phil where she was born, He died 2 years ago, after 31 years of marriage and after his death she traveled to the usa to file his paperwork and I believe to check on his death benefits for her mom, where her mom now recieves a very small pension the way I take it.

I did not know if since he was an american citizen if that would give her more right to get citizenship here.

I am guessing the way my Tax forms are that they would not let me pass, Unless they go off my worth then I would not have a problem.

You are paying for her to complete her nursing requirements and you have never met her?

The first thing you need to do is go meet her in person and get to know who she really is.

anyway, either way.. you still have to meet her first for you to get a k1 or k3 or cr1

it sounds suspicious to me that she and her mom never filed a petition to make her an American citizen.

i don't want to sound like i'm discouraging you, BUT nurses here cannot work in the US without at least 2 years experience... as far as i know.

this is also why hospitals here are exploiting RNs by making them pay the hospitals as interns for two years or sometimes they pay them little allowance.

MEET her first... this is a very good suggestion.

I can't count the pinay i had online ask me to help pay for their education.

For one very few pinay can get tourist visas. Paperwork for her father? She should be a US citizen if her pops was.

As I said! The girl sounds to good to be true and probably is!!

Better off to get her a fiancee visa then marry in the US, its quickier.

2 We try and get her a work visa here in the usa and then marry why she is here?

If you do that, then she will have to come back to PHILIPPINES and then you can file the I-130

3. We apply for a fiancee Visa I believe is k-1

I go with # 3 beacause its quicker result than CR1, then marry her in the USA.

4. We Marry in the Phil and then try to bring her here?

This will take longer as you are now filing for I-130, stick with the fiancee visa... BUT ITS YOUR CHOICE....

Its your annual income they goes with, i.e. what you file in your Income Tax the last 3 years.

With K1 visa she can't get a job right away, you will have to file AOS, be ready to shred about 1400, then she can get job/work legally.

Let me clear a few things up, I didn't' pay her schooling, her dad put her through school up to the time he died an then her aunt paid, she Graduated from nursing school Last year, What I offered to pay is for her to have her final review and Final coaching an her Nursing Test so she could practice in the Phil, I made this offer she never asked anything about it. Then if she make I told her I would offer to pay for her NCLX Examination because I figured it would be easier for her to take there than here.

She has been more than upfront with me sending me Receipts of the payments to the school for her review , sending me copies of her Valid Photo Identification.

Her dad did not speak of any relation back here in the states and she does not know of any, He Was stationed in the Phil where he met her mom and they were married there, She has only been in the usa 1 time, and that was right after her dad died, she came back here and was here for one week to file paperwork and to fix for her mom to get some pension which is not much, Her mom is 68 and her Dad was 72 when he died.

She has a Valid Visa that is still good from that time and said she would like to come to the usa to see me.

I would never send money for a plane ticket, I would only purchase a non refundable ticket to her to come. if she does, but I am thinking more of going there, 1st to meet her an her mom.

Where I also feel since her dad was an American Citizen that , would be the way to approach getting her here in the USA The whole time her dad was Married he never once came back to the usa and he never talked much about it.

But you can tell by her photos and her Id that she is Half American and Half Filipino.

There is a mistake in the answer below. The income requirement is not after taxes.
