Hello,

We are newbies. We are considering a ALL of the options for having my fiancee get to USA ASAP. It is important that she be here a coupld of time this summer to take some exams as to not lose an entire year when exams are again available in 2010.

We were hoping we could have her visa and her moving here by July as we thought up until a few days ago, that it was a 3 month max process. We now see it is a VERY LONG time and Summer time seem out of the question.

So instead of getting into ALL of the questions that we have I will start with one simple one.....

After I submit the I-129F and wait the 150 days or so for approval, can my fiance come to visit me (possibly a few times) for an extended period (under 3 months) and take her exams on a the visa waiver program?

Um, i believe that once you have a k-1 or ANY visa for that matter being processed, you cannot apply for another one, so if you want to do the K-1, (it is faster than the K-3), i dont think she will be able to come to the U.S on a visitors visa. I am not a 100% sure though someone feel free to clean things up. P.S my k-1 application was processed over the summer last year, i dont think it took all that long,i sent it in late march, early april, and i got an approval letter August 11th so like 4 months.

I-129F NOA2 : April 28, 2008

NVC Left : Aug.18, 2008

Packet 3 Received: Sept. 3, 2008

Interview Date : Dec. 18, 2008

APPROVED!!!!

Dec. 19, 2008- Alfredo comes home!

Jan. 5, 2009: Alfredo and I become husband and Wife

March 10, 2009 AOS paperwork sent, will wait for it to arrive via tracking #

March 12, 2009 AOS paperwork arrives in Chicago

March 23, 2009 NOA1 for I-485, I-131, I-765

March 30, 2009-Biometrics letter received, appt date April 10th @11am philly office

April 10, 2009-Biometrics appt. done, in and out in 15 minutes

Nov. 18, 2009-Card production ordered

Yes your fiance can travel freely as long as she does not overstay on her visitor's visa.

Yes, while applying for k1 visa, my fiance was here 2 weeks ago, stayed for 8 days. No problem. At immigration POE, he said, he was sightseeing. Nothing else needs to be said.

Timeline:

2/18/2009: Mailed I-129F Form

2/20/2009: NOA 1 Receipt Date

3/20/2009: NOA 2 Notice Approval Date

05/28/2009: Interview APPROVED

7/22/2009 --POE (LAX)-- We are together forever <3

AOS Journey Begins Here ^------^

7/28/2009 -- Applied for SSN & Registered for Marriage License

8/3/2009 -- Civil Ceremony

8/5/2009 -- Received Marriage Certificate via Express Mail. Pass DMV Written Exam & Received Permit

08/11/2009-- Mailed AOS to Chicago, IL

08/17/2009 -- Check clears $1010 USCIS

8/20/2009- Touched ^---^

8/21/2009-- NOA 1 for I-485 and I-765 Hard Copy

08/29/2009-- Received Biometrics Appointment Letter in the mail, dated 08/26

09/03/2009 -- Early Walk In Biometrics Appt (Original Date 09/23)

09/04/2009 -- Touched ^---^

09/29/2009 -- EAD Card Production

10/07/2009 -- EAD Card Received

10/16/2009 AOS I-485 Interview in Los Angeles(APPROVED)

10/28/2009 -- GC in HAND <3

From the recent discussion here on VJ the key to being admitted on a tourist visa while in the K visa process is showing the strong ties to home for the foreign fiance(e). A job to go back to, home ownership/apartment lease, etc.

I can imagine difficulties that could arise regarding ANY other kind of Visa such as a "TOURIST" visa while a previous one is in process, I was merely asking about a VISA WAIVER for a short (> 3 months) visit where in fact a visa is not required.

So any further thoughts on that are welcome.

Tourist visa or folks coming from visa waiver countries would need to demonstrate the same ties to home. krikit gave you the link to the good info. No wonder she's a mod.
