Timeline

Here is my story:

I came to US in first week of Feb 2004 for a one week vacation I returned home and per request of my friend who was having a hard time returned to stay for three months on March 31st 2004.

Subsequently I have been here ever since. I entered on the VWP from Ireland.

In December 2006 I met my future husband we started dating in May of 2007 and married on September 29th 2007!

I have now overstayed my visa by just under five years and I have not left the US since.

Am I going to have to file a I-601? Or will I be able to file for just AOS?

I guess my case is further complicated by the fact that I got a job in mid April at a restaurant where I was furnished with a fake SSN so that they could pay taxes for me. I was handed what I felt at the time the opportunity of a life time now it doesn't seem like that was true.

I have never claimed to be a USC have no police records etc.

I am meeting an attorney on Thursday but I am at my wits end for my naivety with the fake SSN.

To date I have filed no papers.

We mailed our package on June 9th 2009.

NOA notice date: June 17th

I-130 and I-765 touched: July 1st (but not I-130)

Biometrics: July 9th CANCELLED

Biometrics: July 18th completed

I-485 & I-765 touched: July 20th & 21st

Received interview notice: August 8th

EAD production ordered: August 12th

EAD CARD received: August 17th

EAD Approval notice sent: August 17th

For the overstay, as long as you can prove you entered legally you can just apply for AOS, no waiver, as long as you have no other violations. . . .

For the SSN, that is illegal for reasons having nothing to do with immigration. Please do research on identity theft to understand all the problems that go along with this. It does not matter that you are not using their name, you're possibly using someone else's SS# and that causes a load of issues. It will probably never come up at anything to do with immigration. . .but it is still illegal and wrong.

IMO, don't you think using a SS# for the United States is claiming to be an US citizen? Misrepresenting yourself so you can work? You entered the country knowing you were not supposed to work but you did AND you used a fake SS# which is fraud ( indentity theft) Absolutely do research on Identity theft and look up the penalties if you are convicted.

I will always feel so bad for that. I have called the IRS and the number I was issued has no information on file. I am willing and will no doubt have to take any consequences coming my way. For the most part its not even me that Im sad for its my family anf most of all my husband who has to go through this with me.

I do still have my I-94. I have no other violations.

Hey, give her a break. Some people have problems they don't expound upon on VJ. I'm sure everyone on here has made a mistake or two in the past. Would you really expect her to leave her husband, home, and life behind because she made a bad choice? What would she be going back to in Ireland? It's not exactly a third world country but the average person there isn't living a great life. What would YOU do for love? You don't know anything about her and her situation beyond what she's told us. If you don't know the answer leave her alone and move on. Chiding her isn't being helpful, and I guarantee you it's not going to make her run back home.

I am not going to run back to Ireland that is true if there was any chance of a decent life for my husband we would have done that already.

The circumstances of me meeting my husband was actually in prep of me going back home.

but breaking laws in order to stay here is not the answer. And yes, go back to Ireland and wait like everyone else. I am separated from my husband. I have been married for over a year and a half. I want to be with him but the laws are the laws. I visit him every 6 or 8 weeks. I do what I have to do.

I think she should obey the laws of the United States if she wants to be allowed to live here.
