Hi,

I am a K-3 holder and I will submit my AOS papers in this week.. I have a question about the form I-765, application for employment authorization.. the question 16th which asks eligilibity category.. I am the wife of US citizen.. I said A 9 Is that correct?

I looked at the instruction and wrote A 9.. but I have a friend who is also K-3 and his attorney wrote C 9 for him.. that is why I am confused..

Instructions would seem to indicate so

C9 is for someone who is applying for EAD based on a pending I-485 AOS application. If you are a K-3 not applying for AOS then A9. So my bad that I missed the AOS filing part

Your friend's attorney is right. It should be c(9) for your case. Let me clarify something:

If you are applying I-765 (EAD) ONLY then your category would be (a)(9) and

you would pay total $420 [i-765 Application fee which is $340 + Biometrics ($80)].

Since you are applying for AOS (as a whole package, i.e. 485,131 & 765) then your category is c(9) !..

It does not matter what kind of K visa you have.

EAD application fee is already built in AOS package fee + Biometrics, so altogether AOS fee

is $1,010. Does it make sense now ?

I-130 mailed 01/13/09

I-130 received by USCIS 01/16/09

NOA1 Mail for I-130 received 01/22/09

I-485 Package mailed 02/17/09

I-485 Package received by USCIS 02/20/09

NOA1 Mail for I-485 & I-765 received 02/26/09

NOA2 e-mail for I-130 Approval 03/03/09 (47 Days)

NOA2 Hard Copy of I-130 Approval received 03/07/09

Biometrics Done 03/24/09 (TODAY !...)

NOTE : I DID NOT APPLY FOR I-131 (AP).

Thanks. I am K- and applying for AOS.. I will send both I-485 and I-765 forms.. In this case his attorney has made a mistake..because his and my I-485 not pending..we are applying for it.. am I correct? Thanks!

His attorney is correct, you are both C9. By pending, it means that you are applying for EAD after applying for AOS or both at the same time.

At the time they are making a decision on your EAD, your AOS will be "pending".

I got it now. I`ve corrected it as C9.. Thank you all...

I have two more questions that confused me as well..

1- What is the nonimmigrant visa number on the visa? Is it the control number that is on the right upper side of the visa.. mine starts with 2009.. or is it the RED number on the visa on the rigt side below..

2- On the for I-485 Part II Application type.. I am applying for an adjustment to permanent resident statusbecause: .....................??

I've checked box a that says an immigrant petition giving me an immidately available visa number that has been approved..

but again my friend's attorney checked letter h that says other basis of eligibility........

hah! his attrorney made mistake then??? Thank you so much Cino for your help.. I really appreciate it.. I will send the AOS papers to this addres below? because instructions has two address.. As i understand if I send by usps i will send to this address and if i send by let's say ups i will send to the other address.. am I right? which one i should prefer? Thanks again..

Choose the cheapest one , USPS & send it with Registered Mail.
