To make the story short, we filed for AOS in october. Later my wife went to get her biometrics and we thought everything will go smoothly. Than in december I received a letter asking for all income tax documentation submitted to the IRS for the most recent tax year as required for I-864, Affidavit of Support. So I made a copy of my W2 form and mailed it next day. Today I received a final request for the same information. I already sent them W2 but maybe I should have sent something else? What papers do they need besides W2? I only have form 1040A, so should I just make a copy of it and sent it with w2? The note says it's the final request so i really need to be sure that I'm sending the correct information. Thanks for the help.

Call the IRS 800#. You can order the last 3 years tax transcripts and should receive them in about a week or so. You can also have them FAX them to you the same day.

W-2 won't be enough. You need to send a copy of your tax returns. If you don't have a copy you can request an official Tax Transcript (for more info go to http://www.irs.gov/individuals/article/0,,id=110571,00.html)

The easiest way is to call 1-800-829-1040 to ask for an official transcript.

If I'm reading you right - W-2's are of no value without a copy of the actual income tax return attached. Are you saying you only submitted W-2's with your I-864?

yea I sent just the w2 with my I-864. The only other paper I have is my 1040A. So if I sent w2 again but this time long the 1040A form everything should be ok? Or should order the tax transcript? One more question..if I have all the tax returns done for 2008 with my wife in it, should I send them as well even though they are only asking for 2007?

Yes, if you provide the corresponding 1040's with the W-2's your good to go.

The transcripts are easier to provide, and avoid issues like yours.

You can provide up to 3 years if you feel it will help support your case. (or even more information)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Presumably if you submit the tax return and all supporting documents (such as the W-2's, 1099's etc) you should be ok. A substitute for this would be an IRS Tax Transcript - they are free but take a couple of weeks (maybe longer now that we're in the middle of tax season) to get. Either will work.

Yes, if you provide the corresponding 1040's with the W-2's your good to go.

Just call them and have them fax it over during the call.

I just did it last week, 15 mins or so. :)

Yes. it will be good enough.

If you feel you need to send the other ones, go for it.

But since your RFE was because you only sent the w-2's, you will be good once you send the correct 1040.

What about a proof of current employment like employment letter?

W-2'S aren't enough definitely you need to send your tax returns.IRS transcripts are the most acceptable and less papers too but since you got the final notice you may not have enough time if you will order it now.You should be fine with tax returns and W-2'S.Good luck!

Just like everyone is saying, you need to submit your W2 and your 1040A or get the transcript from IRS. You should be fine with that. Good luck on your AOS journey.
