... also, I know a lot of you have said that you have known people that have been sent home and with bans... There is always 2 sides to a coin, and I have found out by reading extensively on multitudes of forums and threads that some people have come to get married when previously came illegally or have overstayed visas, under false pretense, with criminal records, etc...

If it was NOT allowed to adjust from VWP - then there would be no option to. everyone would have to follow the same route. The ultimate end result is the same: to be with our loved ones. There are several ways to get there, some quicker than others, some more riske than others... whatever route you take, as long as you have a real bona fide marriage, you filled out everything to the best of your knowledge with all the supporting documents and that you know you are being true - I think the sun should shine upon you at interview time.

Overly confident or possibly "happy-go-lucky" attitude on my part you might think?

I'd rather be this way than being frightened by all that has been said here by some poster(s) assuming we commited visa fraud.

Arent people coming to the USA under the VWP and student coming under the F-1 visa placed in the same category as "non-immigrant" visa? you were able to adjust your status when you married. I should be able to as well - doesn't matter which visa you came under in my opinion as long as your marriage is bona fide. By your train of thought, maybe I should go ahead and assume that you came here to study but in reality, you used that visa to perhaps fall in love marry and then adjust to stay here. It certainly seems unjust to think or assume something like that, but that's how it also feel when people assume that couples used the WVP to adjust as a mean of an easier way to "get around the system".

uhhh...no they are not the same at all. why are you going so hard anyways...what do u have to prove.. we were just tryin to help u along with ur process. if everybody who asked for advice and only wanted to hear only the good stuff, then what would the point be. its god to air with caution and just heed the advice..its presented, take it however you want it...

and dont be silly....f-1 and vwp are by no means the same category. i came as a student and 8 years later got married. can u say the same? you are going about this the wrong way. u asked , people answered..now stop with the sherlock holmes ######. the difference between u and is simple.i already got approved. the burden is still on U to convince an IO...u have nothing to prove to me.

Oh... On the USCIS website, it says that "F" visas are non-immigrant visas... My bad!

how long were u in the US via vwp did u get married? if u could just answer this it would help alot.

to say give up is really simple...it would be interesting to find out because under F i and under K stands the same...so i really dont know where is the problem?!?!?

If the officer deciding your case picks to deny it based on one of the other reasons of non-eligibility, they can, and you have no recourse but to accept it because that is one of the requirements of the VWP.

If you overstayed your authorized stay, for example, even if your married, they can deny it. Says they can right there.

But, as I pointed out, and as the OP noted after calling the USCIS, if you can prove your case, you should have no problem.

Case by case, officer by officer. Some luck out, some get denied.

Ultimately it's up to the individual to pick what they will do, and be prepared for the consequences if they choose poorly.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Actually, the most important thing is how long their relationship was. As long as they can show emails, chat, visits, phone records, letters, packages......Music they may have created for each other...wow that would be impressive...that is what matters. I am thinking of presenting the postcards I sent my boyfriend from Germany, his christmas cards for me, the cards his family has given me...so on.

F1 are allowed to get married in the country and adjust status. You are not expected to be here for 4 (bs), 2(ms), 6(bs ms), or 9(bs ms phd) years without relating to human beings. They understand love happens. Specially if you can document it :goofy: .Plus I bet the US is interested in keeping around minds they have educated and molded and bring so much richness to the country (diversity, culture, application of education).

In any case, love shows, people have been asking us if we are married since our second year dating, but we just got married in november.

We have known each other for 3+ years now. I have visited him in Germany twice for 21+ days each time - we have 5 albums of photos, train tickets, conversations, cards - I even included 2 CD that him and I released together ( he is a music producer and I am a vocalist ). We have so much evidence of a bona fide relationship. We get along so well and we hae so much respect for one another with such deep love and caring - we turn people diabetic lol.

I absolutely do not doubt the outcome - we were destined to meet.

its ridicilous to say love and relationship has anything to do with time..my relationship was after 2 month stronger then my first marriage was after 3 years....

and when they look at the case they allready knew before they call up for the interview if the case is clear or not..and they are also able to see if a couple is real or not..they do their job not since yesterday and u can see if u know humans and have the skills wich couple is not bona fide....

i should only up with 8 pics....2 wedding pics one were we was on a party and the other was me on the horse or him on a horse..because one of us makes always the pics so its hard to get both of us on one...and the officer said it dont matter i see ur guys here and the impression that you make is that what count..and when u are not real in love i quit lol..so trust in ur love bring some bills wich both names...bring a joint bankaccount..that is something they really look about and some nice pics and be real and autenthic..that is that what count

When I sent in the AOS and the I-130, I included pages of pictures of our wedding, trips we did together, CDs/music we made together, proof of him added to my bank accounts, copy of bank cards, him added to the cable bill, electric bill, my health insurance, my car insurance, even a copy of my amended lease to have him on there - my name changed to his last name ( copy of the application and the updated SS card )... I mean, i don't know what else to bring with me at the interview. Oh... we are going to our honeymoon next weekend, so I guess i'll take pictures of that and bring them with us to the AOS interview... I am well prepared and confident.

Sounds like you have a lot of evidence, more than we had (also adjusting from VWP)!

I don't see what time has to do with it either - people do the K1 after one or two visits, so I don't see what the big deal is. I don't think anyone was questioning that it is legal to adjust from VWP, I think the point was that you married relatively soon after entering on the VWP, and to use the VWP you must not have immigrant intent - obviuosly it looks as if someone maybe had intent if they marry very soon after entering. If I were you, I would also take evidence that your husband did intend to return home after his VWP stay - we took this to our interview, and although we didn't get asked for it, it did make us feel better knowing that we had that covered should it come up.

Well we married 2 months after he entered the US - you think that was early? We didnt plan anything and it just happened to be on that day, so it is what it is. Finding a JP around here to do a ceremony last minute is not an easy task lol. He does have a copy of his return plane ticket and the fact that he was enrolled for the upcoming school semester. We will bring that with us, along with all the other evidences they are requesting.

Oh, from some of the other posts in this thread, I thought you married much sooner than 2 months!! That doesn't seem too early to me. We married at about 87 days, luckily we didn't have a problem with booking a courthouse ceremony. The school enrollment sounds like good evidence he intended to return :)

Congrats:-) we filed feb 13 and we haven't receive interview sched. But i got papers that said Our case was transfered to california. I hope we don't need interview.

an immediate relative of a US Citizen ( Spouse,Parents,Widow,Widower,Child under 21 of Age)

So...there is it...if u are merry an US Citizen under VWP u can adjust Status...i dont know what is so hard to understand..or why there is any point to be worried...or do u guys give the advise also on the persons who came with K1????

and the point is why i wrote this is because everybody makes stupid comments about the people who married under VWP.

or make them fear that they can be deported or what ever...we have in the same way to proof that we have an bona fide marriage like everybody else too...no matter if K1 K3 oder other visa

So today.... I was coming home from work and my hubby was waiting for me on the porch with great news!

He received a letter from homeland security asking him to appear for his AOS interview on 4-21-09!

Its hard to believe since we filed all the paperwork on Feb 9th 2009. So in 2 months, 11 days we'll be interviewing!

I guess if they give us an approval on that day, we wont be needing the EAD or the AP!

Wow.... I can't believe it!!!! I guess living in the boonies has some advantages after all... :dance:

Is that fast or what?!

We have the same interview date. Mine will be 2:30 pm at San Francisco. How about yours?
